        Introduced  by Sen. GIANARIS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Commerce, Economic  Devel-
          opment and Small Business
 
        AN  ACT  to  amend  the alcoholic beverage control law, in relation to a
          license to sell liquor at retail for consumption on certain premises

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-15)  to  read  as
     3  follows:
     4    (e-15)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied exclusively as a school, provided such prem-
     8  ises constitute a premises for the sale of food or beverages  at  retail
     9  for  consumption on the premises located wholly within the boundaries of
    10  the county of Queens, bounded and described as follows:
    11    ALL THAT CERTAIN PLOT, PIECE OR PARCEL  OF  LAND  situated  lying  and
    12  being  in  the  Borough and County of Queens, City and State of New York
    13  bounded and described as follows;
    14    The location of the Museum would include the Premises,  identified  as
    15  Block  644, p/o Lot 1 on the Tax Map for the Borough of Queens, New York
    16  and known as "Building 13" with legal description as,
    17    BEGINNING a point on the easterly side of 36th Street (60 feet  wide),
    18  distant  82.35 feet northerly from the corner fanned by the intersection
    19  of the easterly side of 36th Street with  the  northerly  side  of  35th
    20  Avenue (80 feet wide);
    21    RUNNING  THENCE  easterly  parallel  with  the  northerly side of 35th
    22  Avenue, 30.54 feet to a point;
    23    THENCE northerly parallel with the easterly side of 36th Street, 34.95
    24  feet to a point;
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    THENCE easterly parallel with the northerly side of 35th Avenue, 61.92
     2  feet to a point;
     3    THENCE  northerly parallel with the easterly side of 36th Street, 7.83
     4  feet to a point;
     5    THENCE easterly parallel with the northerly side of 35th A venue, 107.
     6  75 feet to the westerly side of 37th Street (60 feet wide);
     7    THENCE northerly along the westerly side of 37th Street, 61.32 feet to
     8  a point;
     9    THENCE westerly at right angles to the westerly side of  37th  Street,
    10  200.21 feet to the easterly side of 36th Street;
    11    THENCE  southerly  along the easterly side of 36th Street, 104.10 feet
    12  to the point or place of BEGINNING.
    13    In addition with additional land identified as Block 644, p/o  Lot  1,
    14  as the Expansion Premises,
    15    ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND situate lying and being
    16  in  the Borough and County of Queens, City and State of New York bounded
    17  and described as follows;
    18    BEGINNING at a point on the easterly side  of  36th  Street  (60  feet
    19  wide),  distant 178.45 from the corner fanned by the intersection of the
    20  easterly side of 36th Street, with the northerly side of 35th Avenue (80
    21  feet);
    22    RUNNING THENCE easterly at right angles to the easterly side  of  36th
    23  Street, 200.21 feet to the westerly side of 37th Street;
    24    THENCE  northerly  along  the  westerly side of 37th Street (60 feet),
    25  8.00 feet to a point;
    26    THENCE westerly at right with the westerly side of 37th Street, 200.21
    27  feet to the easterly side of 39th Street;
    28    THENCE southerly along the westerly side of 37th Street, 8.00 feet  to
    29  the point or place of the BEGINNING.
    30    § 2. This act shall take effect immediately.
