        Introduced  by COMMITTEE ON RULES -- read twice and ordered printed, and
          when printed to be committed to the Committee on Rules
 
        AN ACT to amend chapter  73  of  the  laws  of  1940,  relating  to  the
          Lawrence-Cedarhurst  Volunteer and Exempt Firemen's Benevolent Associ-
          ation, Inc., in relation to the purposes of the corporation

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Sections 612.1 and 612.4 of chapter 73 of the laws of 1940,
     2  relating  to  the incorporation of the Lawrence-Cedarhurst Volunteer and
     3  Exempt Firemen's Benevolent Association, Inc., are amended  to  read  as
     4  follows:
     5    § 612.1 Purposes. The purposes of such corporation shall be [the main-
     6  tenance of]: to maintain a suitable headquarters for the members of such
     7  corporation[,  the];  to provide relief, aid and assistance [of such] to
     8  the volunteer members [and their families] of such corporation  who  are
     9  disabled  or  indigent[,  and  the  promotion of] and their families; to
    10  promote and safeguard the welfare of the volunteer members of the corpo-
    11  ration, and their families; to provide for the health and safety of  the
    12  volunteer  members  of the corporation; and to enhance the morale of the
    13  volunteer members of the corporation by providing social and  recreation
    14  activities  for  the  volunteer  members  of  the  corporation,  and the
    15  promotion of the volunteer fire service within the incorporated villages
    16  of Lawrence and Cedarhurst and such other territories that  are  now  or
    17  may hereafter be served by the Lawrence-Cedarhurst Fire Department, Inc.
    18    §  612.4  Precept  for  payment  of  foreign and mutual fire insurance
    19  premium taxes. a. Such corporation shall collect and there shall be paid
    20  to it all tax imposed by [section five  hundred  fifty-three]    article
    21  ninety-one  of  the  insurance law, for fire department use and benefit,
    22  upon premiums on policies of insurance against loss or  damage  by  fire
    23  covering  property situated within the incorporated villages of Lawrence
    24  and Cedarhurst, and within any duly organized  territory  in  which  the

     1  Lawrence-Cedarhurst  Fire  Department,  Inc., may be obligated to render
     2  fire protection.
     3    b.  The  officer  of  such  corporation  designated  by its by-laws to
     4  collect and receive the aforesaid tax shall  have  the  same  powers  as
     5  provided  by  law for the treasurer of a fire department with respect to
     6  such collection and receipt.
     7    c. Such corporation shall also be entitled to receive a share  of  the
     8  tax  imposed  by [section five hundred fifty-four] article ninety-one of
     9  the insurance law, based upon the business written in the territory with
    10  respect to which it is entitled to collect and  receive  the  tax  under
    11  [section  five  hundred fifty-three] article ninety-one of the insurance
    12  law.
    13    d. Such taxes shall [only] be used [for the care and relief  of  disa-
    14  bled or indigent volunteer and exempt firemen and their families] by the
    15  corporation in furtherance of its purposes as set forth in section 612.1
    16  of this article.
    17    § 2. This act shall take effect immediately.
