        Introduced  by  Sen.  SAVINO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Civil Service and Pensions
 
        AN ACT to amend the civil service law, in relation  to  continuation  of
          health insurance benefits for public employees injured or taken ill in
          performance of duty
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. The civil service law is amended by adding  a  new  section
     2  159-d to read as follows:
     3    § 159-d. Health insurance benefits; public employees. Health insurance
     4  benefits  for  a public employee injured or taken ill in the performance
     5  of duty shall continue to be provided to such employee, and if  applica-
     6  ble,  his  or  her spouse and/or dependents, at the same rate and to the
     7  same extent as active employees within the  same  collective  bargaining
     8  unit  occupying  the same civil service position, until such time as the
     9  member has returned to active service, has  separated  from  service  or
    10  retires.  Nothing  in  this  section shall diminish or impair any rights
    11  created by a collective bargaining agreement.

    12    § 2. This act shall take effect immediately.
