AN ACT to amend the insurance law, in relation to including individuals
treated with opioid partial agonist treatment medication as being in
an opioid treatment program for the purposes of certain insurance
coverage and co-payments
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 31-b of subsection (i) of section 3216 of the
2 insurance law, as added by chapter 734 of the laws of 2022, is amended
3 to read as follows:
4 (31-b) Every policy that provides coverage for treatment at an opioid
5 treatment program shall not impose a co-payment fee during the course of
6 treatment on any insured for such treatment. For the purposes of this
7 section "opioid treatment program" means a program or practitioner
8 engaged in opioid treatment of individuals with an opioid agonist or
9 opioid partial agonist treatment medication.
10 § 2. Paragraph 7-b of subsection (l) of section 3221 of the insurance
11 law, as added by chapter 734 of the laws of 2022, is amended to read as
12 follows:
13 (7-b) Every policy that provides coverage for treatment at an opioid
14 treatment program shall not impose a co-payment fee during the course of
15 treatment on any insured for such treatment. For the purposes of this
16 section "opioid treatment program" means a program or practitioner
17 engaged in opioid treatment of individuals with an opioid agonist or
18 opioid partial agonist treatment medication.
19 § 3. Subsection (l-2) of section 4303 of the insurance law, as added
20 by chapter 734 of the laws of 2022, is amended to read as follows:
21 (l-2) Every policy that provides coverage for treatment at an opioid
22 treatment program shall not impose a co-payment fee during the course of
23 treatment on any insured for such treatment. For the purposes of this

1 section "opioid treatment program" means a program or practitioner
2 engaged in opioid treatment of individuals with an opioid agonist or
3 opioid partial agonist treatment medication.
4 § 4. This act shall take effect immediately and shall apply to poli-
5 cies and contracts issued, renewed, modified, altered or amended on and
6 after such date.
