        Introduced  by  Sens. ORTT, CROCI -- read twice and ordered printed, and
          when printed to be committed to the Committee  on  Veterans,  Homeland
          Security  and  Military Affairs -- committee discharged, bill amended,
          ordered reprinted as amended and  recommitted  to  said  committee  --
          reported  favorably from said committee and committed to the Committee
          on Rules -- ordered to a third reading, amended and ordered reprinted,
          retaining its place in the order of third reading
 
        AN ACT to amend the mental hygiene law, in relation to  eligibility  for
          dependents  of military servicemembers for certain developmental disa-
          bility services
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The mental hygiene law is amended by adding a new section
     2  67.09 to read as follows:
     3  § 67.09 Medicaid home  and  community  based  services  eligibility  for
     4            dependents of certain military servicemembers.
     5    A  dependent  of  a member of the armed forces of the United States or
     6  the organized militia of the state, who is  a  legal  resident  of  this
     7  state,  having  previously  been  determined to be eligible for develop-
     8  mental disability services provided by the federal Department of  Health
     9  and  Human  Services,  including waiver services provided under the home
    10  and community based services programs authorized under  Section  1915(c)
    11  of  the Social Security Act, shall retain eligibility for those develop-
    12  mental disability services as long as he or she remains a legal resident
    13  of  the  state,  regardless  of  having  left  the  state  due  to   the
    14  servicemember's military assignment outside the state, and as long as he
    15  or  she is otherwise eligible for such services. A dependent who resides
    16  out-of-state may be placed on the waiting list for  developmental  disa-
    17  bilities   services   if  the  dependent  left  the  state  due  to  the
    18  servicemember's military assignment outside the state.
    19    § 2. This act shall take effect on the first of April next  succeeding
    20  the date on which it shall have become a law.
