Provides that the state liquor authority shall provide, upon application, a one-time credit to any covered entity to be used towards any future application for a license to sell alcohol at retail for on-premises consumption; provides that such credit shall be in the amount that such covered entity paid in fees solely for licenses to sell alcohol on-premises in calendar year two thousand twenty.

AN ACT in relation to certain credits for any future application for a
license to sell alcohol at retail for on-premises consumption; and
providing for the repeal of such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law to the contra-
2 ry, the state liquor authority shall provide, upon application, a one-
3 time credit to any covered entity to be used towards any future applica-
4 tion for a license to sell alcohol at retail for on-premises
5 consumption. Such credit shall be in the amount that such covered enti-
6 ty paid in fees solely for retail licenses to sell alcohol on-premises
7 in calendar year two thousand twenty. Such one-time credit shall only
8 be authorized to apply to license fees related to renewals or applica-
9 tions to sell alcoholic beverages in the same locations for which the
10 covered entity obtained a retail license for on-premises consumption in
11 calendar year two thousand twenty. For purposes of this section,
12 "covered entity" shall mean any sports or cultural organization that
13 held more than one license to sell alcohol at retail for on-premises
14 consumption in calendar year two thousand twenty. Such credits shall be
15 given at no cost to a covered entity and no late fees shall be charged
16 to a covered entity for such credit; however, if requested by the state
17 liquor authority, such covered entity shall still be required to submit
18 any forms or information to the state liquor authority to receive such
19 credit. However, no credit shall be issued or applied pursuant to this
20 section if such covered entity is able to claim a credit for such fees
21 pursuant to any other applicable provision of law.
22 § 2. This act shall take effect immediately and shall expire and be
23 deemed repealed one year after such effective date.
