AN ACT to amend the education law, in relation to establishing special
permits to practice as a clinical laboratory practitioner
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The section heading of section 8608 of the education law,
2 as amended by chapter 147 of the laws of 2018, is amended to read as
3 follows:
4 Limited [and], provisional and special permits.
5 § 2. Subdivision 3 of section 8608 of the education law is renumbered
6 subdivision 4 and a new subdivision 3 is added to read as follows:
7 3. Special permit. (a) The department may issue a special permit to
8 practice as a clinical laboratory practitioner to an individual who has
9 met all requirements for licensure as a clinical laboratory technologist
10 or cytotechnologist, histotechnologist, or certification as a clinical
11 laboratory technician or histotechnician, except such requirements
12 relating to examinations, and provided that the individual is under the
13 general supervision of the director of a clinical laboratory, as deter-
14 mined by the department. Provided, further, that such individual shall
15 file an application with the department for licensure pursuant to
16 section eighty-six hundred five, eighty-six hundred six, eighty-six
17 hundred six-a or eighty-six hundred six-b of this article and for the
18 permit established by subdivision one of this section.
19 (b) This special permit shall be valid for a period of not more than
20 one hundred eighty days or until the time an appropriate examination is
21 taken by the individual, whichever is later, provided that the special
22 license shall be renewable on a form prescribed by the department.
23 (c) Each special permit shall be subject to the disciplinary
24 provisions applicable to licensees pursuant to subarticle three of arti-
25 cle one hundred thirty of this title.
26 § 3. This act shall take effect immediately.
