        Introduced  by  Sen. HINCHEY -- read twice and ordered printed, and when
          printed to be committed to the Committee  on  Cities  2  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted
          to said committee
 
        AN  ACT  authorizing the city of Schenectady to alienate certain parcels
          of land used as parkland and to  provide  other  parcels  of  land  to
          replace such parkland
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subject to the provisions of this act, the city of Schenec-
     2  tady, Schenectady county, acting by and through its governing  body,  is
     3  hereby  authorized  to  discontinue the parkland and alienate such lands
     4  more particularly described in  section  three  of  this  act,  for  the
     5  purpose of relocating Stockade Historic District structures at high risk
     6  from flooding, and upon such other terms and conditions as determined by
     7  the governing body of the city of Schenectady.
     8    § 2. The authorization contained in section one of this act shall take
     9  effect  only upon the condition that the city of Schenectady shall dedi-
    10  cate an amount equal to or greater than the fair  market  value  of  the
    11  waterfront  parkland  being  discontinued towards the acquisition of new
    12  waterfront parkland and/or  towards  capital  improvements  to  existing
    13  waterfront parkland and recreational facilities.
    14    § 3. The parklands authorized by section one of this act to be discon-
    15  tinued  as parkland are described as follows:  All that certain piece or
    16  parcel of land located, situate and lying on the northerly side of Front
    17  Street in the City of Schenectady, County of Schenectady, State  of  New
    18  York and being bounded and described as follows:
    19    BEGINNING  at a point on the northerly street boundary of Front Street
    20  at its intersection with the property division line between lands now or
    21  formerly of City of Schenectady as described in Book  763  Of  Deeds  at

     1  page  300  on the East and lands now or formerly of Francis M. McGovern,
     2  Sr. as described in book 1813 of deeds at page 730 on the West.
     3    THENCE  North  29  Degrees  57' 32" West, along said property division
     4  line, a distance of 290.02 feet to a point at its intersection with  the
     5  property  division line between said lands of City of Schenectady on the
     6  South and lands now or formerly of the Trustees of Union College in  the
     7  County of Schenectady and State of New York as described in Book 1525 of
     8  Deeds at page 98 on the North.
     9    THENCE  running  along said property division line the following seven
    10  courses and distances:
    11    North 74 Degrees 13' 21" East, a distance of 54.63 feet to a point;
    12    North 15 Degrees 50' 17" West, a distance of 82.61 feet to a point;
    13    North 73 Degrees 45' 08" West, a distance of 38.52 feet to a point;
    14    North 40 Degrees 48' 17" West, a distance of 57.65 feet to a point;
    15    North 11 Degrees 30' 05" West, a distance of 29.56 feet to a point;
    16    North 61 Degrees 16' 47" East, a distance of 57.54 feet  to  a  point;
    17  and
    18    South 73 Degrees 48' 38" East, a distance of 113.78 feet to a point at
    19  its  intersection  with the property division line between said lands of
    20  City of Schenectady on the west and lands now or formerly of cost corpo-
    21  ration as described in book 1566 of deeds at page 469 on the East.
    22    THENCE South 16 Degrees 16' 07" East,  along  said  property  division
    23  line,  a distance of 418.26 feet to a point on the said northerly street
    24  boundary of Front Street.
    25    THENCE South 74 Degrees 00' 31" West, a distance of 84.75 feet to  the
    26  point or place of beginning.
    27    Containing 54,611 square feet or 1.25 acres of land.
    28    §  4.  In  the event that the city of Schenectady received any funding
    29  support or assistance from the  federal  government  for  the  purchase,
    30  maintenance  or  improvement of the parklands set forth in section three
    31  of this act, the discontinuance and alienation of such parkland  author-
    32  ized  by  the  provisions  of this act shall not occur until the city of
    33  Schenectady has complied with any federal requirements pertaining to the
    34  alienation or conversion of such  parklands,  including  satisfying  the
    35  secretary  of  the  interior  that the alienation or conversion complies
    36  with all conditions which the secretary of the interior deems  necessary
    37  to  assure  the  substitution of other lands shall be equivalent in fair
    38  market value and usefulness to the lands being alienated or converted.
    39    § 5. This act shall take effect immediately.
