        Introduced  by Sen. CARLUCCI -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --

        AN  ACT  authorizing  the transfer of certain state lands in the town of
          Orangetown
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Notwithstanding any other law to the contrary, the commis-
     2  sioner of general services is authorized to  sell  unappropriated  state
     3  land,  including  any  buildings and improvements thereon erected within
     4  the bounds set forth in section two of this act, to the town of  Orange-
     5  town  for  fair  market value, and upon such additional terms and condi-
     6  tions as the commissioner may deem proper. The town  shall  have  ninety
     7  days  in which to advise the commissioner of general services whether or
     8  not it wishes to acquire such unappropriated state  land  for  a  public
     9  purpose.  If  it  wishes  to acquire such unappropriated state land, the

    10  town shall have one hundred twenty days from so  notifying  the  commis-
    11  sioner in which to conclude the negotiation of the sale.
    12    §  2.    The  lands,  with buildings and improvements thereon erected,
    13  subject to the provisions of this act are located within  that  part  of
    14  the  town  of  Orangetown  in  the  county of Rockland bounded by a line
    15  described as follows:
    16    BEGINNING at the intersection of the northern line of county of  Rock-
    17  land route number twenty and the western line of the Palisades Intestate
    18  Parkway;  thence  westerly along the northern line of county of Rockland
    19  route number twenty to the intersection of the northern line  of  county
    20  of  Rockland route number twenty and the eastern line of county of Rock-
    21  land route number twenty-three; thence northerly along the eastern  line
    22  of  county  of Rockland route number twenty-three to the intersection of

    23  the eastern line of county of Rockland route number twenty-three and the
    24  southern line of Convent Road; thence easterly along the  southern  line
    25  of Convent Road to the intersection of the southern line of Convent Road
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  and  the western line of the Palisades Interstate Parkway; thence south-
     2  erly along the western line of the Palisades Interstate Parkway  to  the
     3  point of BEGINNING.
     4    § 3. No existing remedy or executed contract, lease or agreement shall
     5  be impaired by this act.
     6    §  4.  Any  transaction  for  the sale, conveyance or transfer of land

     7  authorized by this act is subject to any statement of facts an  accurate
     8  survey  may  show  pertaining to any such land and is further subject to
     9  any covenants, conditions, restrictions, easements and rights-of-way, if
    10  any, contained in instruments of record affecting said premises  so  far
    11  as the same may now be in force and effect.
    12    § 5. This act shall take effect immediately.
