AN ACT to amend the environmental conservation law, in relation to the
installation of trash capture nets
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The environmental conservation law is amended by adding a
2 new section 17-0832 to read as follows:
3 § 17-0832. Additional requirement; trash capture nets.
4 Notwithstanding any other provision of law, rule or regulation, the
5 commissioner shall promulgate rules and regulations requiring the
6 department to install or cause to be installed at the outlet of any
7 point source that empties into any waters of the state a trash capture
8 net for purposes of collecting garbage, refuse, and other debris. For
9 purposes of this section, a "trash capture net" shall mean a commercial
10 grade, reusable, open-meshed material designed to capture pollutants as
11 small as five millimeters in diameter.
12 § 2. This act shall take effect on the one hundred twentieth day after
13 it shall have become a law. Effective immediately the addition, amend-
14 ment and/or repeal of any rule or regulation necessary for the implemen-
15 tation of this act on its effective date are authorized to be made and
16 completed on or before such date.
