        Introduced  by  Sen.  GOLDEN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend a chapter of the laws of 2017, relating to  establishing
          a  temporary  state  commission  to  study  child  abuse  and  neglect
          prevention, as proposed in legislative bills numbers S.  233A  and  A.
          5769A,  in  relation  to  establishing  a temporary state taskforce to
          study child abuse and neglect prevention
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Sections  1,  2,  3, 4, and 5 of a chapter of the laws of
     2  2017, establishing a temporary state commission to study child abuse and
     3  neglect prevention, as proposed in legislative bills numbers S. 233A and
     4  A. 5769A, are amended to read as follows:
     5    Section 1. A temporary state [commission] taskforce on child abuse and
     6  neglect prevention is hereby established to examine, evaluate  and  make
     7  recommendations concerning child abuse and neglect prevention efforts in
     8  the  state  with  the goal of preventing child removals, lowering foster
     9  care placements and increasing family reunification.
    10    § 2. The [commission]  taskforce  shall  consist  of  [nine]  thirteen
    11  members,  with  adequate  geographic  representation, to be appointed as
    12  follows: [three] seven members to be appointed by  the  governor;  three
    13  members  to  be  appointed by the temporary president of the senate; and
    14  three members to be appointed  by  the  speaker  of  the  assembly.  The
    15  members shall have demonstrated experience and expertise in the field of
    16  child  abuse  and  neglect  prevention.  The members of the [commission]
    17  taskforce shall receive no compensation for their services, but shall be
    18  reimbursed for their actual  and  necessary  expenses  incurred  in  the
    19  performance of their duties under this act.
    20    §  3.  The [commission] taskforce shall meet and may hold public hear-
    21  ings, and may undertake any studies, inquiries, surveys or  analyses  it
    22  deems relevant in cooperation with or by agreement with any other public
    23  or private agency.

     1    §  4.  The  [commission]  taskforce  shall  focus on issues related to
     2  improving the delivery of prevention programs statewide,  including  but
     3  not limited to an examination of the following:
     4    (a)  best  practices  that  have demonstrated outcomes in lowering the
     5  rate of child abuse and neglect;
     6    (b) best practices for identifying and engaging families  successfully
     7  in prevention programs, including primary prevention programs;
     8    (c) the availability of quality prevention programs, including primary
     9  prevention  programs, statewide, including the identification of regions
    10  where such programs are lacking;
    11    (d) the availability [and adequacy] of  state  funds  for  prevention,
    12  including  primary prevention, including where those funds are allocated
    13  and how they are being utilized; and
    14    (e) the extent to which local social services  districts  are  funding
    15  prevention   programs,  including  primary  prevention  programs,  on  a
    16  regional basis, and identification of impediments to local funding.
    17    § 5. The [commission] taskforce shall make a report of its findings to
    18  the governor, the temporary president of the senate and the  speaker  of
    19  the assembly no later than [one year] two years after the effective date
    20  of this act. Such report shall include any recommendations for any regu-
    21  latory  or  statutory  changes,  or  changes  in  funding for prevention
    22  programs.
    23    § 2. Section 6 of a chapter of the laws of 2017, establishing a tempo-
    24  rary state commission to study child abuse and  neglect  prevention,  as
    25  proposed  in  legislative bills numbers S. 233A and A. 5769A, is amended
    26  to read as follows:
    27    § 6. This act shall take effect immediately and shall  expire  and  be
    28  deemed repealed [two] three years after such effective date.
    29    §  3.  This act shall take effect immediately; provided, however, that
    30  section one of this act shall take effect on the same date  and  in  the
    31  same  manner  as a chapter of the laws of 2017, establishing a temporary
    32  state commission  to  study  child  abuse  and  neglect  prevention,  as
    33  proposed  in  legislative  bills  numbers  S.  233A  and A. 5769A, takes
    34  effect.
