PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend a chapter of the laws of 2017, directing the metropol- itan transportation authority and the New York city transit authority to study aboveground transit infrastructure, as proposed in legisla- tive bills numbers S. 5754-A and A. 7562-A, in relation to lead paint remediation reporting for the metropolitan transportation authority's and the New York city transit authority's aboveground transit infras- tructure The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Sections 1, 2, and 3 of a chapter of the laws of 2017, 2 directing the metropolitan transportation authority and the New York 3 city transit authority to study aboveground transit infrastructure, as 4 proposed in legislative bills numbers S. 5754-A and A. 7562-A, are 5 amended to read as follows: 6 Section 1. [The metropolitan transportation authority and the New York7city transit authority, in consultation with the department of environ-8mental conservation and the department of health, shall conduct a study9to examine and evaluate aboveground stations, elevated trestles, and10elevated subway and railway tracks owned or controlled by the metropol-11itan transportation authority, regarding, but not limited to the follow-12ing determinations:13(a) review past renovations to stations to determine the amount of14lead paint abatement;15(b) determine the degree to which the metropolitan transportation16authority complies with federal and state air quality laws and regu-17lations;18(c) establish recommendations to further lead paint abatement, enhance19air quality controls, and to ensure protection of public health and the20environment; and21(d) determine the fiscal impact of any aforementioned recommendations.22The metropolitan transportation authority and the New York city trans-23it authority, in consultation with the department of environmentalEXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11263-04-7S. 7292 2 1conservation and the department of health, shall limit such study to a2statistically significant subset of the aboveground stations, elevated3trestles, and elevated subway and railway tracks to be representative of4all aboveground transit infrastructure. Testing shall include all five5boroughs, low-income neighborhoods, and densely populated areas of the6city of New York.] On or before July 1, 2018, and every year thereafter, 7 the president of the New York city transit authority shall submit a 8 written report to the governor, temporary president of the senate, and 9 speaker of the assembly that identifies all current or planned capital 10 projects that will involve the removal of existing lead-based paint from 11 and the repainting of any of the aboveground stations, elevated tres- 12 tles, or elevated subway tracks operated by the New York city transit 13 authority. For each such project, the report will describe the work to 14 be undertaken and measures that the New York city transit authority will 15 take to ensure adequate protection of public health and the environment 16 from lead particulates. The report shall also include a description of 17 the New York city transit authority policy for lead particulate manage- 18 ment for such capital projects. 19 § 2. [On or before March 1, 2018, the chairman of the metropolitan20transportation authority and the chairman on the New York city transit21authority shall submit a written report to the governor, temporary pres-22ident of the senate, speaker of the assembly and mayor of the city of23New York, with the findings and recommendations of the study conducted24pursuant to section one of this act.25§ 3.] This act shall take effect immediately. 26 § 2. This act shall take effect on the same date and in the same 27 manner as a chapter of the laws of 2017, directing the metropolitan 28 transportation authority and the New York city transit authority to 29 study aboveground transit infrastructure, as proposed in legislative 30 bills numbers S. 5754-A and A. 7562-A, takes effect.
