        Introduced  by  Sen. KENNEDY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the social services law, in relation to establishing  an
          internet  mapping  resource  of  child  care providers and afterschool
          programs; to amend the education law, in relation to administration of
          afterschool programs; and to repeal subdivisions 39 and 40 of  section
          2  of  the  social services law, relating to the definitions of after-
          school program and summer program
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  483-h  of the social services law, as added by a
     2  chapter of the laws of 2017, amending the social services  law  and  the
     3  education law relating to directing the council on children and families
     4  to  establish an online listing and map of publicly funded or registered
     5  afterschool and school age child care programs and to expand the  duties
     6  of  the  commissioner  of social services and the commissioner of educa-
     7  tion, as proposed in legislative bills numbers S. 683 and  A.  2183,  is
     8  amended to read as follows:
     9    §  483-h. [List of] Internet mapping resource of school age child care
    10  providers and afterschool programs.  1. The council, in accordance  with
    11  information  made  available  to it by the office of children and family
    12  services pursuant to section seventeen of this chapter and  provided  to
    13  it  by  the state education department pursuant to section three hundred
    14  five of the education law, shall develop and make  available  through  a
    15  link on its website an internet mapping resource of:
    16    (a) [a listing of:
    17    (1)]  all  recipients of competitive grants awarded or administered by
    18  the state office of children and family services or the state  education
    19  department  for  the purpose of providing: [(i)] afterschool [or summer]
    20  programs [as defined in section two of this chapter,] or extended learn-
    21  ing time, including but not limited to grants for such purposes  awarded
    22  under  section  thirty-six  hundred  forty-one of the education law; [or
    23  (ii) community schools, including but not limited  to  grants  for  such

     1  purposes  awarded  under  section  thirty-six  hundred  forty-one of the
     2  education law;] and
     3    [(2)] (b) all registered school age child care providers registered by
     4  the office of children and family services[; and
     5    (b) a map displaying the locations of the award recipients and provid-
     6  ers  described in subparagraph one of paragraph (a) of this subdivision]
     7  except for those who in accordance with  paragraph  eight-a  of  section
     8  three  hundred ninety of this chapter have opted out of providing infor-
     9  mation online.
    10    2. The [listing] internet mapping  resource  shall  include  for  each
    11  grant  recipient  or  provider  the  recipient's or provider's name, the
    12  address at which the program is offered except for those who in  accord-
    13  ance  with  paragraph  eight-a  of  section three hundred ninety of this
    14  chapter have opted out of providing information online,  and  the  [name
    15  and]  phone  number  [of an individual who is authorized to answer ques-
    16  tions regarding] for the program.
    17    3. The [listing and map] internet mapping resource described in subdi-
    18  vision one of this section shall be updated no less than  once  a  year.
    19  [The  listing  and  map  shall also be updated within ninety days of the
    20  date of execution or expiration of contracts with grant recipients  when
    21  all  such  contracts  are executing or expiring for a particular compet-
    22  itive grant.]
    23    4. The council may include locations and  information  for  additional
    24  relevant programs as it sees fit.
    25    §  2.  Subdivision  (i)  of  section 17 of the social services law, as
    26  added by a chapter of the laws of 2017, amending the social services law
    27  and the education law relating to directing the council on children  and
    28  families  to  establish  an online listing and map of publicly funded or
    29  registered afterschool and school age child care programs and to  expand
    30  the  duties  of the commissioner of social services and the commissioner
    31  of education, as proposed in legislative bills numbers  S.  683  and  A.
    32  2183, is amended to read as follows:
    33    (i)  make  available to the council on children and families[, through
    34  the OpenNY website,] information regarding: (1) all recipients of grants
    35  awarded or administered by the [state] office  of  children  and  family
    36  services  for the purposes of providing afterschool [or summer] programs
    37  [as defined in section two of  this  chapter,  extended  learning  time,
    38  including  but  not  limited  to  grants for such purposes awarded under
    39  section thirty-six hundred forty-one of the education law, or  community
    40  schools,  including  but not limited to grants for such purposes awarded
    41  under section thirty-six hundred forty-one of the  education  law];  and
    42  (2)  registered school age child care providers registered by the office
    43  of children and family services. For each grant  recipient  or  provider
    44  the recipient's or provider's name, and the address at which the program
    45  is offered[, and the name] except for those who in accordance with para-
    46  graph eight-a of section three hundred ninety of this chapter have opted
    47  out  of  providing information online, and the phone number [of an indi-
    48  vidual who is authorized to answer questions regarding] for the  program
    49  will  be made available [through the OpenNY website] no less than once a
    50  year [and within ninety days of the date of execution or  expiration  of
    51  contracts with grant recipients when all such contracts are executing or
    52  expiring for a particular competitive grant]; and
    53    § 3. Subdivision 56 of section 305 of the education law, as added by a
    54  chapter  of  the  laws of 2017, amending the social services law and the
    55  education law relating to directing the council on children and families
    56  to establish an online listing and map of publicly funded or  registered

     1  afterschool  and school age child care programs and to expand the duties
     2  of the commissioner of social services and the  commissioner  of  educa-
     3  tion,  as  proposed  in legislative bills numbers S. 683 and A. 2183, is
     4  amended to read as follows:
     5    56.  The  commissioner  shall  provide  to the council on children and
     6  families, in a format identified by the council,  information  regarding
     7  all  recipients of grants awarded or administered by the [state] depart-
     8  ment for the purposes of providing afterschool [or summer] programs  [as
     9  defined in section two of the social services law], or extended learning
    10  time,  including  but  not  limited  to grants for such purposes awarded
    11  under section thirty-six hundred forty-one of this chapter[, or communi-
    12  ty schools, including but  not  limited  to  grants  for  such  purposes
    13  awarded under section thirty-six hundred forty-one of this chapter]. For
    14  each  [grant  recipient or provider] program the [recipient's or provid-
    15  er's] program's name, the address at which the program is  offered,  and
    16  the  [name  and]  phone  number  [of  an individual who is authorized to
    17  answer questions regarding] for the program  will  be  provided  to  the
    18  council  no less than once a year [and within ninety days of the date of
    19  execution or expiration of contracts with grant recipients when all such
    20  contracts are executing or expiring for a particular competitive grant].
    21    § 4.  Subdivisions 39 and 40 of section 2 of the social services  law,
    22  as  added by a chapter of the laws of 2017, amending the social services
    23  law and the education law relating to directing the council on  children
    24  and  families  to establish an online listing and map of publicly funded
    25  or registered afterschool and school age  child  care  programs  and  to
    26  expand the duties of the commissioner of social services and the commis-
    27  sioner  of  education,  as proposed in legislative bills numbers S.  683
    28  and A. 2183 are REPEALED.
    29    § 5. This act shall take effect on the  same  date  and  in  the  same
    30  manner  as  a  chapter of the laws of 2017, amending the social services
    31  law and the education law relating to directing the council on  children
    32  and  families  to establish an online listing and map of publicly funded
    33  or registered afterschool and school age  child  care  programs  and  to
    34  expand the duties of the commissioner of social services and the commis-
    35  sioner of education, as proposed in legislative bills numbers S. 683 and
    36  A.  2183,  takes effect; provided that the amendments to subdivision (i)
    37  of section 17 of the social services law made by section two of this act
    38  shall not affect the repeal of such  subdivision  and  shall  be  deemed
    39  repealed therewith.
