AN ACT to amend the state technology law, in relation to the functions,
powers and duties of the office of information technology services
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 1 of section 103 of the state technology law,
2 as added by chapter 430 of the laws of 1997 and such section as renum-
3 bered by chapter 437 of the laws of 2004, is amended to read as follows:
4 1. To act as the official state planning and coordinating office for
5 the advancement of technology to improve government efficiency [and],
6 effectiveness and accessibility, and perform all necessary and appropri-
7 ate services required to fulfill these duties;
8 § 2. Section 103 of the state technology law is amended by adding a
9 new subdivision 12-c to read as follows:
10 12-c. (a) To develop an action plan, in consultation with the depart-
11 ment of health and the office of the state comptroller, to improve the
12 data collection, analysis, utilization, and reporting practices of the
13 department of health. In developing such action plan, the office,
14 department of health, and comptroller shall consider requiring:
15 (i) expanded use of infection control data, including but not limited
16 to the Nosocomial Outbreak Reporting Application, the Health Electronic
17 Response Data System, and nursing home surveys;
18 (ii) utilization of the United States Centers for Disease Control and
19 Prevention Infection Control Assessment and Response tool;
20 (iii) increased data sharing with local health districts; and
21 (iv) reporting public health data in a conspicuous location and in a
22 format capable of download in a spreadsheet format.
23 (b) Such action plan shall be completed and submitted to the governor,
24 the temporary president of the senate, the minority leader of the

1 senate, the speaker of the assembly and the minority leader of the
2 assembly, no later than January first, two thousand twenty-three, and
3 shall be posted publicly on the office's website, along with a brief
4 description of the action plan thereof;
5 § 3. This act shall take effect immediately.
