        Introduced  by  Sen.  LITTLE -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --
          committee  discharged,  bill amended, ordered reprinted as amended and
          recommitted to said committee
 
        AN ACT to authorize the village of Hudson Falls, in the county of  Wash-
          ington, to discontinue use of certain parkland

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subject to the provisions  of  this  act,  the  village  of
     2  Hudson  Falls, in the county of Washington, is hereby authorized, acting
     3  by and through its board of trustees, to discontinue the use as parkland
     4  of the parcel described in section two of this  act,  and  to  use  such
     5  parcel for municipal parking.
     6    §  2.    For  the  purposes of this act, the description of the parcel
     7  authorized to be discontinued as parkland is described as follows:
     8    All that tract or parcel of land situated in  the  village  of  Hudson
     9  Falls, in the county of Washington, bordered on the west by Main street,
    10  on  the  north  by Clark street, on the east by land owned by the Hudson
    11  Falls central school district and on the south by Locust  street,  which
    12  is  more  particularly depicted on a "Map of a Planemetric & Topographic
    13  Survey" of lands of the village of Hudson  Falls,  dated  September  10,
    14  2015,  by  Darrah  Land  Surveying,  PLLC, containing approximately 2.84
    15  acres.
    16    § 3.  The authorization, granted pursuant to section one of this  act,
    17  shall be subject to a requirement that the village of Hudson Falls dedi-
    18  cate  an  amount  equal  to or greater than the fair market value of the
    19  parcel, described in section two of this act, for  capital  improvements
    20  of  existing  park and recreational facilities and/or for acquisition of
    21  additional park and recreational facilities.
    22    § 4. In the event that the village of Hudson Falls received any  fund-
    23  ing  support or assistance from the federal government for the purchase,
    24  maintenance or improvement of the  parklands set forth in section two of
    25  this act, discontinuance and alienation of such parkland  authorized  by
    26  the  provisions  of  section  two  of this act shall not occur until the

     1  village of Hudson Falls  has  complied  with  any  federal  requirements
     2  pertaining  to the alienation or conversion of such parklands, including
     3  satisfying the secretary of the interior that the alienation or  conver-
     4  sion  complies  with  all conditions which the secretary of the interior
     5  deems necessary to assure the  substitution  of  other  lands  shall  be
     6  equivalent  in  fair  market  value  and usefulness to the lands   being
     7  alienated or converted.
     8    § 5. This act shall take effect immediately.
