AN ACT to amend the tax law, in relation to vendor fees paid to certain
vendor tracks
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph (ii) of paragraph 1 of subdivision b of
2 section 1612 of the tax law is amended by adding a new clause (D-1) to
3 read as follows:
4 (D-1) notwithstanding any provision of law to the contrary, when the
5 vendor track is located in the county of Genesee and within forty miles
6 of a Native American class III gaming facility, at a rate of thirty-sev-
7 en percent of the total revenue wagered at the vendor track after payout
8 for prizes pursuant to this chapter;
9 § 2. This act shall take effect April 1, 2019.
