AN ACT to amend the election law, in relation to the solicitation of
political contributions from employees by an officer or employee of
the state
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The election law is amended by adding a new section 17-158
2 to read as follows:
3 § 17-158. Solicitation of political contributions; subordinate
4 employees. Any officer or employee of the state, or of a political
5 subdivision thereof, who knowingly solicits a political contribution for
6 any party committee, candidate, or person from any subordinate employee,
7 shall be guilty of a class E felony, regardless of whether a political
8 contribution is made by such subordinate employee; provided, however,
9 that nothing herein shall be deemed to prohibit an employee from making
10 a voluntary political contribution.
11 § 2. This act shall take effect immediately.
