        Introduced  by Sen. MURPHY -- (at request of the Department of Transpor-
          tation) -- read twice and ordered printed,  and  when  printed  to  be
          committed to the Committee on Transportation
 
        AN  ACT  to  amend  the  railroad  law,  in  relation to requiring joint
          inspection of traffic signals
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. The railroad law is amended by adding a new section 53-f to
     2  read as follows:
     3    §  53-f.  Joint inspection of traffic signals.  1. Notwithstanding the
     4  provisions of any other law to the contrary, the commissioner is author-
     5  ized to establish, implement, and exercise oversight over a  program  of
     6  inspection  of  traffic control devices interconnected with highway-rail
     7  at grade crossing warning systems.
     8    2. Pursuant to the program established under subdivision one  of  this
     9  section,  the  department  of transportation shall establish a procedure
    10  applicable to every railroad corporation and  each  municipality  having
    11  jurisdiction  of  a highway on which there is an at grade rail crossing.
    12  Such procedure shall provide for the coordinated operation and  biennial
    13  inspection  of  any  traffic control devices interconnected with a high-
    14  way-rail at grade crossing warning system.
    15    § 2. This act shall take effect on the one hundred eightieth day after
    16  it shall have become a law; provided that,  effective  immediately,  the
    17  commissioner  of transportation is authorized to promulgate any rules or
    18  regulations necessary for the implementation of this act on  its  effec-
    19  tive date.
