        Introduced  by  Sen.  ORTT  --  read twice and ordered printed, and when
          printed to be committed to the Committee on Finance
 
        AN ACT to amend the executive law, in relation to the timely appointment
          of heads of agencies
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. The executive law is amended by adding a new section 33 to
     2  read as follows:
     3    § 33. Timely appointment of heads of agencies. 1.  For the purposes of
     4  this section, "state agency" shall mean any state board,  bureau,  divi-
     5  sion,  commission,  committee,  public  authority, public benefit corpo-
     6  ration, council, office,  or  other  governmental  entity  performing  a
     7  governmental or proprietary function for the state. "State agency" shall
     8  not include state departments provided for in the New York state consti-
     9  tution.
    10    2.  A  state  agency  shall  only  have an acting head for one hundred
    11  eighty days, or two hundred seventy days if the senate is adjourned when
    12  the acting head is appointed if  confirmation  of  such  appointment  is
    13  required.  Where confirmation for an appointment is required, the gover-
    14  nor shall submit a name for the head of a department with an acting head
    15  before one hundred eighty days or two hundred seventy days if the senate
    16  is adjourned when the acting head was appointed.
    17    § 2. This act shall take effect immediately.
