        Introduced  by  Sen. REICHLIN-MELNICK -- read twice and ordered printed,
          and when printed to be committed to the Committee on Rules
 
        AN ACT to amend the town law, in relation to providing  for  a  stay  on
          certain  zoning board of appeals decisions upon the commencement of an
          article 78 proceeding against such board

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  267-c of the town law is amended by adding a new
     2  subdivision 5 to read as follows:
     3    5. Stay on certain decisions. Commencement of a proceeding against the
     4  zoning board related to the issuance of a permit or other land use deci-
     5  sion challenging the validity of such decision  shall  stay  proceedings
     6  upon such decision appealed from.
     7    § 2. This act shall take effect immediately.
