AN ACT to amend the mental hygiene law, in relation to integrated hous-
ing
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The mental hygiene law is amended by adding a new section
2 13.42 to read as follows:
3 § 13.42 Integrated housing plan.
4 (a) The commissioner, in consultation with the developmental disabili-
5 ties advisory council, the department of health, the division of housing
6 and community renewal, and the most integrated settings coordinating
7 council and other agencies as determined appropriate by the commissioner
8 shall establish a plan to increase housing opportunities for people with
9 developmental disabilities. The plan shall include, but not be limited
10 to:
11 (1) The creation and maintenance of an inventory of affordable and
12 accessible rental units for individuals with developmental disabilities;
13 and
14 (2) Identification of strategies to facilitate individuals receiving
15 or eligible for home and community based (HCBS) waivers to live in their
16 own home, leased apartment, or family's home, when such a placement is
17 their informed choice and the most integrated setting appropriate to
18 their needs. Any such strategies at a minimum shall address:
19 (i) facilitating opportunities for individuals with developmental
20 disabilities, including students transitioning from educational programs
21 to live independently in their own home or apartment and away from their
22 parental home;
23 (ii) increasing the stock of affordable and accessible rental units
24 for individuals with developmental disabilities;
25 (iii) increasing and expanding access to rental subsidies for individ-
26 uals with developmental disabilities;

1 (iv) building understanding and awareness of informed choices for
2 independent living among individuals with developmental disabilities,
3 families public and private organization, developers and Medicaid
4 service coordinators;
5 (v) reviewing and evaluating potential federal and state policy chang-
6 es that will facilitate increased access and availability of services
7 and supports that permit individuals to choose more independent living
8 options; and
9 (vi) assessing and advancing coordinated plan implementation.
10 (b) The commissioner, in consultation with the developmental disabili-
11 ties advisory council, the department of health, the division of housing
12 and community renewal, and the most integrated settings coordinating
13 council and other agencies as determined appropriate by the commissioner
14 shall develop the plan with input from stakeholders, including individ-
15 uals with developmental disabilities, parents and guardians of individ-
16 uals with developmental disabilities, advocates and providers of
17 services for individuals with developmental disabilities.
18 (c) The plan required pursuant to this section shall be developed and
19 submitted to the temporary president of the senate, the speaker of the
20 assembly and the chairs of appropriate senate and assembly standing
21 committees, and posted on the website of the office for people with
22 developmental disabilities within one hundred eighty days of the centers
23 for medicare and medicaid services' approval of the state's 1915(b)/(c)
24 HCBS waiver application.
25 § 2. This act shall take effect immediately.
