        AN ACT to amend the public health law,  in  relation  to  requiring  the
          department  of  health to post on its website certain data relating to
          personnel employed or affiliated with health care facilities

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  public health law is amended by adding a new section
     2  206-c to read as follows:
     3    § 206-c. Special requirements with respect to hospital,  nursing  home
     4  and other healthcare facility staffing data. 1. For the purposes of this
     5  section, the following terms shall have the following meanings:
     6    (a) "Covered entity" means:
     7    (i)  a  "hospital"  as  defined in section twenty-eight hundred one of
     8  this chapter;
     9    (ii) any agency established pursuant to  article  thirty-six  of  this
    10  chapter;
    11    (iii)  a  "hospice"  as  defined  in section four thousand two of this
    12  chapter; and
    13    (iv) an adult care facility under the department's regulatory authori-
    14  ty, pursuant to article seven of the social services law.
    15    (b) "Personnel" means persons employed by or affiliated with a covered
    16  entity, whether paid or unpaid, including but not limited to  employees,
    17  members  of  the medical and nursing staff, contract staff, students and
    18  volunteers, who engage in activities, that if such person  was  infected
    19  with  COVID-19, he or she could potentially expose other covered person-
    20  nel, patients or residents to such disease.
    21    (c) "New York state surge and flex operations center" means the  state
    22  operated center led by the department to monitor staffing operations and
    23  trends  statewide,  provide  guidance  to  healthcare facilities and aid
    24  facilities with staffing shortages.

     1    2. The commissioner shall compile and post on the department's website
     2  in a conspicuous location and in a  format  capable  of  download  in  a
     3  spreadsheet format, the following data on a weekly basis:
     4    (a)  The  total  number of personnel who are employed by or affiliated
     5  with a covered entity in New York state;
     6    (b) The total number of personnel who are no  longer  employed  by  or
     7  affiliated  with  a covered entity in New York state, and the reason for
     8  leaving such employment or affiliation;
     9    (c) The total number of requested personnel from the  New  York  state
    10  surge and flex operations center; and
    11    (d)  The  total  number  of  personnel  employed  or affiliated with a
    12  covered entity as a result of the New York state surge  and  flex  oper-
    13  ations center.
    14    3.  The  data posted pursuant to subdivision two of this section shall
    15  be organized by county, date, personnel title and any license or certif-
    16  ication held by such personnel and covered  entity,  and  shall  include
    17  data retroactive to August sixteenth, two thousand twenty-one.
    18    § 2. This act shall take effect immediately.
