        AN ACT to amend the labor law and the  parks,  recreation  and  historic
          preservation  law,  in  relation  to regulation of geological man-made
          mechanical boat attractions

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 2 of section 870-c of the labor law, as amended
     2  by chapter 643 of the laws of 1986, is amended to read as follows:
     3    2. "Amusement park" means a tract or area used principally as a perma-
     4  nent  location  for amusement devices or structures. Such term shall not
     5  include geological man-made mechanical boat attractions  as  defined  in
     6  section 1.03 of the parks, recreation and historic preservation law.
     7    §  2.  Section 1.03 of the parks, recreation and historic preservation
     8  law is amended by adding a new subdivision 19 to read as follows:
     9    19. "Geological man-made mechanical boat attraction"  means  a  device
    10  used  on man-made waterways, man-made tunnels and man-made lakes for the
    11  transport of persons for the purposes of entertainment.
    12    § 3. Section 13.13 of the parks, recreation and historic  preservation
    13  law,  as  amended by chapter 528 of the laws of 2004, is amended to read
    14  as follows:
    15    § 13.13 Regulation of boating and water sports. Except when prohibited
    16  by the laws of the United States, the commissioner or other state agency
    17  may, by rule or regulation, regulate water  sports  and  the  operation,
    18  speed  and  mooring  of  boats in or upon any waters or waterways in the
    19  reservations and parks under the jurisdiction  of  the  office  or  such
    20  state  agency. Such rules and regulations shall also apply to any waters
    21  offshore from any bathing beach within the jurisdiction of the office or
    22  such state agency, and to any waters offshore of Jones Beach state park,
    23  Robert Moses state park and Orient Beach state park, but not to exceed a
    24  distance of one thousand feet from the shore line. Any regulation of the

     1  Palisades interstate park commission, adopted hereunder,  shall  not  be
     2  effective  until  approved  by  the commissioner. The commissioner shall
     3  also  have  jurisdiction  over  geological  man-made   mechanical   boat
     4  attractions, as defined in this chapter, operated on man-made waterways,
     5  man-made tunnels and man-made lakes for the transport of persons for the
     6  purposes of entertainment but which are not part of an amusement park as
     7  defined in article twenty-seven of the labor law.
     8    § 4. This act shall take effect immediately.
