        Introduced  by  Sen.  MURPHY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations
 
        AN ACT to direct the empire state development corporation to  conduct  a
          study on the feasibility of a minority and women-owned business enter-
          prise capacity mentorship program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. 1. The empire state development corporation shall conduct a
     2  study to explore the feasibility of a minority and women-owned  business
     3  enterprise  capacity mentorship program. The study should focus on which
     4  agencies and industries would benefit most from such program, the utili-
     5  zation of any existing  minority  and  women-owned  business  enterprise
     6  mentorship  programs,  and  any  fiscal  implications.  The  study shall
     7  specifically focus on:
     8    a. which state agencies would benefit most from such  program  concen-
     9  trating in construction;
    10    b.  which  state agencies would benefit most from such program concen-
    11  trating in professional services;
    12    c. which state agencies would benefit most from such  program  concen-
    13  trating in non-professional services;
    14    d.  which  state agencies would benefit most from such program concen-
    15  trating in purchases of commodities;
    16    e. the duration of time minority and women-owned business  enterprises
    17  should participate in each program concentration described in paragraphs
    18  a through d of this subdivision;
    19    f.  the  feasibility  that  such successful completion of such program
    20  could be used as a factor for prequalifying participating  minority  and
    21  women-owned business enterprises; and
    22    g.  how  such  program  can be tailored to better prepare minority and
    23  women-owned business enterprises for  bidding  on  contracts  with  such
    24  agencies upon successful completion of the program.
    25    2.  Within twelve months of the effective date of this act, the empire
    26  state development corporation shall issue a report of its  findings  and

     1  recommendations  to  the governor, the temporary president of the senate
     2  and the speaker of the assembly. Such report shall include, but  not  be
     3  limited to, the following:
     4    a.  actions that can be implemented to establish such capacity mentor-
     5  ship program, a plan of action for such implementation,  and  the  esti-
     6  mated  cost  of  the program including any additional division personnel
     7  that may be required;
     8    b. any regulatory actions required by any agency in order to implement
     9  such program, a plan of action for implementing such  actions,  and  the
    10  estimated cost of such implementation;
    11    c.  actions  that require statutory changes in order to be implemented
    12  and the estimated cost of such implementation; and
    13    d. the extent to which any existing minority and women-owned  business
    14  enterprise  mentorship program, including pursuant to section 147 of the
    15  state finance law, has been implemented, and  the  relative  success  of
    16  such programs.
    17    3.  Within  twenty-four  months of the effective date of this act, the
    18  empire state development corporation shall issue a report detailing  the
    19  actions  taken  to  implement  the  recommendations of such study to the
    20  governor, the temporary president of the senate and the speaker  of  the
    21  assembly. Such report shall include a full examination of all aspects of
    22  a  minority  and  women-owned  business  enterprise  capacity mentorship
    23  program, the benefits of such program, a proposed plan of action for the
    24  permanent establishment of such program and the estimated cost  of  such
    25  program.
    26    § 2. This act shall take effect immediately.
