        Introduced by Sens. HARCKHAM, MAY -- read twice and ordered printed, and
          when  printed to be committed to the Committee on Rules -- recommitted
          to the Committee on  Environmental  Conservation  in  accordance  with
          Senate  Rule  6, sec. 8 -- committee discharged, bill amended, ordered
          reprinted as amended and recommitted to said committee

        AN ACT to amend the  environmental  conservation  law,  in  relation  to
          increasing sales of zero-emission vehicles
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 19-0306-b of the environmental conservation law  is
     2  amended by adding a new subdivision 6 to read as follows:
     3    6.  a.  (i)  The  department,  the  New York state energy research and
     4  development authority, the department of motor vehicles, and the depart-
     5  ment of transportation, in consultation with the other  state  agencies,
     6  shall report on December thirty-first, two thousand twenty-four and on a
     7  bi-annual  basis  thereafter  until  December thirty-first, two thousand
     8  thirty-two, the state's zero-emission vehicle sales by new motor vehicle
     9  dealers, as defined in section four hundred fifteen of the  vehicle  and
    10  traffic  law,  except  for  manufacturers  that  manufacture or assemble
    11  exclusively zero-emissions vehicles, or is a subsidiary,  affiliate,  or
    12  controlled  entity  of  such a manufacturer, as outlined in subparagraph
    13  (iii) of paragraph f of subdivision seven of such section.
    14    (ii) Notwithstanding any provision of subparagraph (iii) of  paragraph
    15  f  of  subdivision  seven of section four hundred fifteen of the vehicle
    16  and traffic law, if the department finds  in  its  initial  report  that
    17  projections  of  sales by new motor vehicle dealers, except for manufac-
    18  turers that manufacture or assemble exclusively zero-emissions vehicles,
    19  or is a subsidiary, affiliate, or controlled entity of such  a  manufac-
    20  turer,  fail  to show that thirty-five percent of vehicle sales in model
    21  year two thousand twenty-six will be  zero-emission  vehicles  then  the
    22  department  of  motor  vehicles  shall  issue  up to ten certificates of

     1  registration pursuant to section four hundred fifteen of the vehicle and
     2  traffic law for entities that  manufacture  or  assemble  zero-emissions
     3  vehicles and have no franchised motor vehicle dealers in New York.
     4    b.  If  the  bi-annual  report  on December thirty-first, two thousand
     5  twenty-eight finds projections of sales by new  motor  vehicle  dealers,
     6  except  for manufacturers that manufacture or assemble exclusively zero-
     7  emissions vehicles, or is a subsidiary, affiliate, or controlled  entity
     8  of  such  a manufacturer, fail to show that sixty-eight percent of sales
     9  by model year two thousand thirty will be zero-emissions  vehicles  then
    10  the  department  of  motor  vehicles  shall  issue  up to ten additional
    11  certificates of registration pursuant to section four hundred fifteen of
    12  the vehicle and traffic law for entities that  manufacture  or  assemble
    13  zero-emissions  vehicles and have no franchised motor vehicle dealers in
    14  New York.
    15    c. If the bi-annual report  on  December  thirty-first,  two  thousand
    16  thirty-two  finds  projections  of  sales  by new motor vehicle dealers,
    17  except for manufacturers that manufacture or assemble exclusively  zero-
    18  emissions  vehicles, or is a subsidiary, affiliate, or controlled entity
    19  of such a manufacturer, fail to show that one hundred percent  of  sales
    20  by  model  year two thousand thirty-five will be zero-emissions vehicles
    21  then the department of motor vehicles shall issue up to  ten  additional
    22  certificates of registration pursuant to section four hundred fifteen of
    23  the  vehicle  and  traffic law for entities that manufacture or assemble
    24  zero-emissions vehicles and have no franchised motor vehicle dealers  in
    25  New York.
    26    § 2. This act shall take effect immediately.
