AN ACT in relation to directing the department of environmental conser-
vation to issue a report outlining a plan to hydraulically contain and
remediate the Navy Grumman plume emanating of contaminants and chemi-
cals in the underground aquifer and drinking water of the southeastern
portion of Nassau county
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The New York state department of environmental conservation
2 shall create and deliver to the state legislature a report detailing the
3 options of intercepting and remediating a groundwater plume of contam-
4 inants, including but not limited to PCE and TCE, emanating from the
5 former Naval Weapons Industrial Plant operated by the United States Navy
6 and the Grumman Aircraft Engineering Corporation facilities in Bethpage,
7 town of Oyster Bay, county of Nassau.
8 § 2. This report must focus on the utilization of hydraulic contain-
9 ment and state of the art remediation practices to remove these contam-
10 inants without utilizing well head treatment, which is a measure of last
11 resort only. It must focus on how to accomplish this goal in a timely
12 manner so as to stop the migration of the Navy Grumman plume before it
13 reaches the public water supply wells of the Massapequa water district
14 and the South Farmingdale water district as well as the New York Ameri-
15 can Water Corporation wells. It must be designed to also protect the
16 natural resources, specifically the fresh water bodies, tributaries,
17 wetlands and the salt water natural resources of the Great South Bay
18 from these contaminants.
19 § 3. This report shall estimate the cost, scope, and timetable of such
20 a project and how the department of environmental conservation would,
21 along with enlisting the assistance of the New York State department of
22 Law and the United States Department of Justice, enforce the law and
23 cause the United States Navy to pay for or reimburse the costs associ-
24 ated with this project.
25 § 4. This act shall take effect immediately.
