Go to top STATE OF NEW YORK ________________________________________________________________________ 7840 IN SENATE March 1, 2018 ___________ Introduced by Sen. RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to expand- ing the types of goods made and the methods of sale used by home processors The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The agriculture and markets law is amended by adding a new 2 section 16-b to read as follows: 3 § 16-b. Homemade products. The commissioner shall promulgate rules and 4 regulations to execute and carry into effect the following: 5 1. a review of the ingredients and foods home processors are prohibit- 6 ed from using and making; 7 2. in consultation with the department of health, modifications to 8 expand the ingredients that may be used and the types of goods that may 9 be offered for sale by home processors consistent with the standards and 10 best practices of food safety; and 11 3. approved home-processed product methods of sale to individuals, 12 restaurants, retailers and grocers: 13 (a) direct and indirect internet sales; 14 (b) home-based in-person sales; 15 (c) home-based delivery services; and 16 (d) community-supported agriculture subscriptions. 17 § 2.
