        Introduced  by  Sen.  LANZA  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the highway law, in  relation  to  transferring  certain
          land to the city of New York department of parks and recreation and to
          the  state  department  of  environmental conservation and designating
          such lands as parklands and open space
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 349-f of the highway law, as amended by chapter 558
     2  of the laws of 2010, is amended to read as follows:
     3    § 349-f. New York city routes. The following existing or proposed main
     4  routes or thoroughfares, are designated herein, as aforesaid, viz.:
     5    New  England  thruway  from  the  Westchester  county line to Bruckner
     6  expressway; Bruckner expressway from New England thruway  to  Robert  F.
     7  Kennedy  bridge  approach; Hutchinson river parkway from the Westchester
     8  county line to the Bronx-Whitestone bridge approach; Bronx river parkway
     9  from the Westchester county line to Bruckner  expressway;  Henry  Hudson
    10  parkway from the Westchester county line to Miller highway excepting the

    11  Henry  Hudson  bridge,  provided that no portion of this route from West
    12  Seventy-second street to the Cross Bronx expressway shall be constructed
    13  or reconstructed so as to encroach in any way on or over any land mapped
    14  or used for park purposes except for such temporary encroachment  of  no
    15  more  than  ten feet in width from seventy-third street to seventy-sixth
    16  street as may be essential during and for the purpose of  reconstruction
    17  or  repair  of  the existing roadway following which there shall be full
    18  restoration of park land; Major Deegan expressway  from  the  Robert  F.
    19  Kennedy  bridge  to  Central  Park avenue at the Westchester county line
    20  together with a connection to Broadway and along Broadway  to  Manhattan
    21  college  parkway;  Cross  Bronx expressway from George Washington bridge
    22  approach to Throgs Neck bridge; Throgs  Neck  expressway  from  Bruckner

    23  expressway  to  Throgs  Neck  bridge; Arthur V. Sheridan expressway from
    24  Cross-Bronx expressway to  Bruckner  expressway;  Mosholu  parkway  from
    25  Henry  Hudson  parkway  to Bronx river parkway; Bronx and Pelham parkway
    26  from Bronx river parkway to New England thruway; Boston road from  Bronx

    27  county  line; a connection between Brooklyn-Queens expressway and North-
    28  ern boulevard in the vicinity of Grand Central  parkway;  Grand  Central

    29  parkway  from  Robert  F. Kennedy bridge approach to Nassau county line;
    30  Whitestone expressway from Bronx-Whitestone bridge approach to Van  Wyck
    31  expressway and continuing to Grand Central parkway; Clearview expressway
    32  from  Throgs  Neck  bridge  to  Nassau expressway; Richmond parkway from
    33  [Staten Island expressway to] the Outerbridge crossing  approach  to  La
    34  Tourrette  Park  at  Richmond  Avenue;  Staten  Island  expressway  from
    35  Goethals bridge to the Verrazano-Narrows bridge  with  a  connection  to
    36  Bayonne  bridge;  [Willowbrook  parkway from Staten Island expressway to
    37  Great Kills park;] West Shore expressway from Staten  Island  expressway
    38  to  Outerbridge  crossing; Shore Front drive northerly from the terminus
    39  of West Shore expressway at Staten Island expressway,  thence  generally

    40  along  the shore lines of Kill Van Kull, the Narrows, Lower New York bay
    41  and Raritan bay to the approach to Outerbridge crossing.
    42    § 2.  Upon the completion by the city of New  York  of  the  following
    43  traffic improvements:
    44    (a)  at  the  intersection  of Rockland Avenue and Brielle Avenue, the
    45  widening of Rockland Avenue sufficiently to  improve  safety  sightlines
    46  for motorists and pedestrians;
    47    (b)  the creation of a new road stent, along the boundaries on the New
    48  York city map designated as Ashworth Street,  sufficient  in  length  to
    49  allow  motorists  on  Rockland  Avenue  traveling  northbound toward the
    50  Staten Island Expressway to safely exit Rockland Avenue and connect with
    51  Forest Hill Road, thereby reducing congestion  at  the  existing  inter-
    52  section of Rockland Avenue and Forest Hill Road;

    53    (c)  at  Rockland Avenue and Forest Hill Road, a widening which allows
    54  sufficient stacking capacity for a dedicated left-turn lane and a right-
    55  turn lane heading south toward Richmond Avenue;

     1    (d) a Nadine Street by-pass  road  shall  be  constructed  paralleling
     2  Rockland Avenue from Nevada Avenue to the intersection of McCully Avenue
     3  and Richmond Road; and
     4    (e)  a  new  access road connecting Forest Hill Road to the College of
     5  Staten Island campus
     6    all right, title and interest in property as defined  in  the  highway
     7  law  as  the  Willowbrook  Parkway  from the Staten Island Expressway to
     8  Richmond Road, shall be vested in the department of parks and recreation
     9  of the city of New York.
    10    § 3.  Upon the completion by the city of New  York  of  the  following
    11  traffic improvements:

    12    (a)  at  the  intersection  of  Ocean  Terrace and Todt Hill Road, the
    13  creation of  dedicated  right-turn  and  left-turn  lanes  in  all  four
    14  directions;
    15    (b)  at  the  intersection  of  Manor  Road  and  Rockland Avenue, the
    16  creation of dedicated right-turn and left-turn lanes on Rockland  Avenue
    17  in  the  westbound direction, and on Manor Road in the southbound direc-
    18  tion; and including, to improve  safety,  the  realignment  of  Rockland
    19  Avenue at the severe S-curve within the right-of-way cloverleaf; and
    20    (c)  at  the intersection of Arthur Kill Road and Richmond Avenue, the
    21  Korean War Veterans Parkway Terminus Project at Richmond Avenue
    22    all right, title and interest in property as defined  in  the  highway
    23  law  as  the  Richmond  Parkway from a point 60 feet south of the Staten
    24  Island expressway to Richmond Avenue,  shall  be  vested  in  the  state

    25  department of environmental conservation.
    26    § 4.  Upon completion of the traffic improvements required by sections
    27  two  and three of this act, the parcels defined in such sections of this
    28  act shall be used for parks/open space purposes, shall not be  used  for
    29  transportation  purposes  and  shall  not  be  sold,  leased, exchanged,
    30  donated, or  otherwise  disposed  of  or  used  for  other  than  public
    31  park/open  space purposes without the express authority of an act of the
    32  legislature, which shall provide for the substitution of other lands  of
    33  equal  environmental  value  and fair market value and reasonably equiv-
    34  alent usefulness and location to  those  to  be  discontinued,  sold  or
    35  disposed  of,  and  such  other requirements as shall be approved by the
    36  commissioner of parks and recreation of the city of  New  York  and  the

    37  state commissioner of environmental conservation.
    38    §  5.  All existing portions of open and traveled streets (for example
    39  Rockland Avenue and the intersection of  Ocean  Terrace  and  Todt  Hill
    40  Road)  as  well  as  new portions specified in sections two and three of
    41  this act shall be vested in the city of New York under the  auspices  of
    42  the department of transportation of such city.
    43    § 6. There shall be set aside by the state a sum of money equal to the
    44  cost  of  the traffic improvements required by sections two and three of
    45  this act upon the parcels that are de-mapped pursuant to this act, paya-
    46  ble on the application of the city of New York.
    47    § 7. This act shall take effect immediately.
