        Introduced  by  Sen. REICHLIN-MELNICK -- read twice and ordered printed,
          and when printed to be committed to the Committee on Rules
 
        AN ACT to amend the general business law, in relation to the manufacture
          of seasonal and decorative lighting products containing lead;  and  to
          repeal section 1376-b of the public health law relating thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 1376-b of the public health law, as  amended  by  a
     2  chapter  of  the laws of 2021 amending the public health law relating to
     3  the manufacture and sale of seasonal and  decorative  lighting  products
     4  containing  lead, as proposed in legislative bills numbers S. 5675-A and
     5  A. 4522-A, is REPEALED.
     6    § 2. The general business law is amended by adding a new article  25-C
     7  to read as follows:
     8                                 ARTICLE 25-C
     9                          PRODUCTS CONTAINING LEAD
    10  Section  389-s. Manufacture and sale of seasonal and decorative lighting
    11                   products containing lead.
    12    § 389-s. Manufacture and sale  of  seasonal  and  decorative  lighting
    13  products  containing  lead.  1.  When  used in this title, "seasonal and
    14  decorative lighting product" shall mean portable, plug-connected, tempo-
    15  rary-use lighting products and accessories that have a nominal  120-volt
    16  input voltage rating.
    17    (a) Lighting products within the scope of this rule are factory-assem-
    18  bled with push-in, midget or miniature screw base lamp holders connected
    19  in series or parallel, directly across the 120-volt input.
    20    (b)  Such  lighting  products  include, but are not limited to lighted
    21  decorative outfits such as wired holiday string lights, pre-lit  artifi-
    22  cial  Christmas  trees,  plants,  flowers  or wreaths, stockings, stars,
    23  candles and light sculptures.
    24    2. On each seasonal and decorative lighting product manufactured, sold
    25  or delivered by a manufacturer or distributed within  this  state  after
    26  the  effective  date  of  this  section that contains an electrical cord
    27  casing in which lead is present in a quantity greater than  one  hundred

     1  parts  per million, there shall be printed thereon or attached thereto a
     2  warning label.
     3    3. Such warning label shall contain the following statement: "WARNING:
     4  HANDLING  THE  COATED  ELECTRICAL WIRE OF THIS PRODUCT MAY EXPOSE YOU TO
     5  LEAD. WASH HANDS THOROUGHLY AFTER USE."
     6    4. Any manufacturer who violates this section shall be  subject  to  a
     7  civil  penalty  of  not  more  than  five  hundred dollars for each such
     8  violation.
     9    § 3. Section 399-g of the general business law is  renumbered  section
    10  389-t.
    11    §  4.  This  act  shall  take  effect on the same date and in the same
    12  manner as a chapter of the laws of 2021 amending the public  health  law
    13  relating to the manufacture and sale of seasonal and decorative lighting
    14  products  containing  lead,  as proposed in legislative bills numbers S.
    15  5675-A and A. 4522-A, takes effect.
