Provides that with regard to promotional examinations for a position which exists in only one state agency, consent of such state agency must be granted before eligibility for such exam is offered to those in the non-competitive or labor class.

AN ACT to amend the civil service law, in relation to promotional exam-
ination eligibility
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 11 of section 52 of the civil service law, as
2 amended by chapter 214 of the laws of 1989, is amended to read as
3 follows:
4 11. Notwithstanding any other provision of law, the [state department
5 of] civil service department may, for titles designated by it, extend to
6 employees in the state service who are holding or who have held a posi-
7 tion in the non-competitive or labor class of such service the same
8 opportunity as employees in the competitive class to take promotion
9 examinations [if such examinations are to be held in conjunction with
10 open competitive examinations]. For titles that exist in only one agen-
11 cy, the department shall obtain the concurrence of such agency before
12 extending eligibility to take promotional examinations for such titles
13 to employees in the state service who are holding or who have held a
14 position in the non-competitive or labor class.
15 § 2. This act shall take effect immediately.
