AN ACT to amend the vehicle and traffic law, in relation to establishing
a minimum age for passengers to ride in the front seat of a motor
vehicle
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 1229-c of the vehicle and traffic
2 law, as amended by chapter 18 of the laws of 2005, paragraph (c) as
3 amended by chapter 405 of the laws of 2009, is amended to read as
4 follows:
5 2. No person shall operate a motor vehicle unless all front seat
6 passengers (a) [under] are over the age of [sixteen are restrained by a
7 safety belt] twelve ; [or] and (b) [if they are under the age of four,
8 by a specially designed seat which is either permanently affixed or
9 affixed to such vehicle by a safety belt as required by subdivision one
10 of this section, or in the event that the weight of such passenger under
11 the age of four exceeds forty pounds, such passenger may be restrained
12 (i) in an appropriate child restraint system as defined in subdivision
13 four of this section used with combination lap safety and shoulder
14 harness belts or (ii) by a lap safety belt in the event such vehicle is
15 not equipped with combination lap safety and shoulder harness belts or
16 all the combination lap safety and shoulder harness belts are being used
17 to properly restrain other passengers who are under the age of sixteen;
18 or (c) if they are age four or older but under age eight, (i) are
19 restrained in an appropriate child restraint system as defined in subdi-
20 vision four of this section used with combination lap safety and shoul-
21 der harness belts or (ii) are restrained in a lap safety belt in the
22 event such vehicle is not equipped with combination lap safety and
23 shoulder harness belts or all the combination lap safety and shoulder
24 harness belts are being used to properly restrain other passengers who
25 are] if under the age of sixteen are restrained by a safety belt.
26 § 2. This act shall take effect on the first of November next succeed-
27 ing the date on which it shall have become a law.
