        Introduced  by  Sen. LAVALLE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government
 
        AN ACT to amend chapter 238 of the laws of 1963 relating to  incorporat-
          ing  the Port Jefferson Volunteer Firemen's Benevolent Association, in
          relation to its purpose and the use of foreign fire insurance  premium
          taxes

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Sections 3 and 7 of chapter 238 of the laws of 1963  relat-
     2  ing  to  incorporating the Port Jefferson Volunteer Firemen's Benevolent
     3  Association is amended to read as follows:
     4    § 3. Purposes. The purposes of such corporation shall be  the  mainte-
     5  nance  of  suitable  headquarters  for,  and  the promotion of fraternal
     6  intercourse among the members of such corporation, the relief,  aid  and
     7  assistance  of such members and their families who are injured, disabled
     8  or indigent, to promote and  safeguard  the  welfare  of  the  volunteer
     9  members  of  the  corporation,  and  their  families; to provide for the
    10  health and safety of the volunteer members of the  corporation;  and  to
    11  enhance  the  morale  of  the  volunteer  members  of the corporation by
    12  providing social and recreational activities for the  volunteer  members
    13  of  the  corporation,  and the promotion of the welfare of the volunteer
    14  fire service within the  Port  Jefferson  fire  district  and  territory
    15  provided with fire protection by contract with such fire district.
    16    § 7. Precept for payment of foreign fire insurance premium taxes. Such
    17  corporation  shall  collect  and  there  shall  be  paid to it all taxes
    18  imposed by section [five hundred fifty-three] ninety-one hundred four of
    19  the insurance law, for fire department use and  benefit,  upon  premiums
    20  for  insurance against loss or damage by fire covering property situated
    21  within the territory protected by  the  Port  Jefferson  volunteer  fire
    22  department, located in the town of Brookhaven, Suffolk county, New York,
    23  or  within  any  duly  organized  territory  in which the Port Jefferson
    24  volunteer fire  department  is  or  may  be  obligated  to  render  fire
    25  protection. The officer of said corporation designated by its by-laws to
    26  collect  and  receive the aforesaid tax shall have all the powers and be

     1  subject to all the provisions of the insurance law, relating to treasur-
     2  ers of fire departments. Such corporation  shall  also  be  entitled  to
     3  receive  a share of the tax imposed by section [five hundred fifty-four]
     4  ninety-one  hundred  five  of the insurance law, based upon the business
     5  written in the territory with respect to which it is entitled to collect
     6  and receive the tax under section [five hundred fifty-three]  ninety-one
     7  hundred  four  of  the insurance law. Such taxes shall only be used [for
     8  the care and relief of disabled or indigent volunteer and exempt  volun-
     9  teer  firemen  and  their families] by the corporation in furtherance of
    10  its purposes as set forth in section three of this act.
    11    § 2. This act shall take effect immediately;  provided  however,  that
    12  the  amendments  to section 7 of chapter 238 of the laws of 1963 made by
    13  section one of this act shall apply to taxes due on premiums received on
    14  and after January 1, 2021.
