        Introduced  by  Sen.  RIVERA -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the executive law, in relation  to  the  appointment  of
          interpreters to be used in parole board proceedings
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 8 of section 259-i of  the  executive  law,  as
     2  added  by    chapter  473  of  the  laws  of 2016, is amended to read as
     3  follows:
     4    8. Foreign born or non-English speaking person before the board.  Upon
     5  notification from the department pursuant to section two hundred  fifty-
     6  nine-e  of this article, or upon the request of any foreign born or non-
     7  English speaking person who is scheduled to participate in an interview,
     8  parole release hearing, preliminary hearing or revocation hearing, there
     9  shall be appointed from the New York state office  of  general  services
    10  statewide administrative services contract, a qualified interpreter [who
    11  is  certified  by  a recognized national or New York state credentialing
    12  authority] to interpret the proceedings to and the statements or  testi-
    13  mony  of such person. The board shall determine a reasonable fee for all
    14  such interpreting services, the cost of which shall be a charge upon the
    15  board of parole. No such request or appointment shall cause a  delay  of
    16  release from incarceration of such person.
    17    §  2.  This  act  shall  take  effect on the same date and in the same
    18  manner as  chapter 473 of the laws of 2016, takes effect.
