        Introduced  by Sen. BORRELLO -- read twice and ordered printed, and when
          printed to be committed to the Committee on Health
 
        AN ACT to amend the public health law, in relation to the fee for  issu-
          ance of birth and death records in the city of Jamestown
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 4173 of the public health law,  as
     2  amended  by  chapter  293  of  the  laws  of 2019, is amended to read as
     3  follows:
     4    3. (a) [The] Except as otherwise provided in  paragraph  (b)  of  this
     5  subdivision, the registrar shall be entitled to a fee of ten dollars for
     6  each  certification  of  birth  or  death  or for each certified copy or
     7  certified transcript of any record of a birth or of a  death  or  for  a
     8  certification  that  a  search  discloses  no  record of a birth or of a
     9  death, furnished by him to an applicant, except that  no  fee  shall  be
    10  charged  for a search, certification of birth or death or certified copy
    11  or certified transcript of a birth or a death  record  to  be  used  for
    12  school entrance, employment certificate or for purposes of public relief
    13  or  government  compensation  or  when required by the veterans adminis-
    14  tration to be used in determining  the  eligibility  of  any  person  to
    15  participate  in  the  benefits  made  available by the veterans adminis-
    16  tration, provided, however, that if such registrar is a city clerk, town
    17  clerk or village clerk, he shall collect such fees for and on behalf  of
    18  the city, town or village in which he serves, provided, however, that an
    19  amount equivalent to the sum of such fees shall be paid at least monthly
    20  by  such city, town or village to such city clerk, town clerk or village
    21  clerk entitled to receive fees as a registrar of vital statistics.
    22    (b) Notwithstanding paragraph (a) of this subdivision, in the  follow-
    23  ing  county  jurisdictions  the  fee  shall  be set by the county health
    24  commissioner: Chemung, Monroe, Onondaga, Tompkins; and in the  following
    25  local  jurisdictions the fee shall be set by the local legislative body:
    26  city of Oswego, city of Albany, city of Jamestown.   In  such  jurisdic-
    27  tions,  the  fee may be set up to the amount charged by the commissioner
    28  as prescribed in subdivision two of section forty-one  hundred  seventy-
    29  four of this title.
    30    § 2. This act shall take effect immediately.
