        Introduced  by  Sen. AMEDORE -- read twice and ordered printed, and when
          printed to be committed  to  the  Committee  on  Local  Government  --
          reported  favorably  from  said  committee,  ordered  to first report,
          amended on first report,  ordered  to  a  second  report  and  ordered
          reprinted, retaining its place in the order of second report

        AN  ACT  to  amend  the  agriculture and markets law, in relation to dog
          licensing in the village of St. Johnsville
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraph (b) of subdivision 1 of section 109 of the agri-
     2  culture and markets law, as amended by section 4 of part T of chapter 59
     3  of the laws of 2010, is amended to read as follows:
     4    (b) Application for a dog license shall be made to the  clerk  of  the
     5  town,  city,  or  county  or, in the counties of Nassau and Westchester,
     6  incorporated village in which the dog is  harbored  or  to  the  village
     7  clerk  of  those villages in the county of Rockland with a population of
     8  fifteen thousand or more  which  have  elected  to  accept  applications
     9  pursuant  to the provisions of this paragraph or to the village clerk of
    10  the village of Newark in the county of Wayne upon the  election  of  the
    11  village  of  Newark  pursuant  to  the  provisions  of  this  paragraph.
    12  Provided, however, that in the counties of Nassau and  Westchester,  the
    13  board  of trustees of any incorporated village may by resolution provide
    14  that applications for licenses shall no longer be made  to  the  village
    15  clerk,  but  to  the clerk of the town in which the village is situated.
    16  Provided further, however, that in the county of Rockland, the board  of
    17  trustees  of any incorporated village with a population of fifteen thou-
    18  sand or more may by resolution provide  that  application  for  licenses
    19  shall  be  made to the village clerk. Provided further, however, that in
    20  the county of Wayne, the board of trustees of the village of Newark  may
    21  by resolution provide that application for licenses shall be made to the
    22  village clerk. Provided further, however, that in the county of Montgom-
    23  ery,  the  board  of  trustees  of  the village of St. Johnsville may by
    24  resolution provide that application for licenses shall be  made  to  the
    25  village  clerk.  The governing body of any town or city or, in the coun-

     1  ties of Nassau and Westchester, incorporated village or in the county of
     2  Rockland, those villages with a population of fifteen thousand  or  more
     3  which  have  so  elected  to  accept applications [or], in the county of
     4  Wayne,  the  village  of Newark if such village has so elected to accept
     5  applications or, in the county of Montgomery, the village of St.  Johns-
     6  ville  if  such  village  has  so elected to accept applications may, on
     7  resolution of such body, authorize that such application be made to  one
     8  or  more  named  dog control officers of any such town, city or village.
     9  The issuance of any license by any  such  officer  shall  be  under  the
    10  control  and supervision of the clerk. In the case of a seized dog being
    11  redeemed or a dog being otherwise obtained from a county animal  shelter
    12  or pound, such application may be made to the county dog control officer
    13  in charge of such facility. In the case of a dog being redeemed or a dog
    14  being  adopted  from  a  shelter  or  pound  established,  maintained or
    15  contracted for, pursuant to section one hundred fourteen of  this  arti-
    16  cle,  such  application  may  be  made  to the manager of such facility,
    17  provided such manager has been authorized by the municipality  in  which
    18  the  prospective owner resides to accept such application. Such authori-
    19  zation shall be requested by the governing body of the pound or  shelter
    20  and  the  granting  or  denial  of  such  authorization  shall be in the
    21  discretion of the municipality in which the prospective owner resides.
    22    § 2. This act shall take effect immediately.
