AN ACT to amend the labor law, in relation to minimum wage requirements
for certain employers and employees
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 652 of the labor law is amended by adding two new
2 subdivisions 7 and 8 to read as follows:
3 7. Notwithstanding the provisions of any other subdivision of this
4 section, every employer of fifty or less employees shall pay for each
5 hour worked a wage of not less than, or if greater, such other wage as
6 may be established by federal law pursuant to 29 U.S.C. section 206 or
7 its successors:
8 (a) New York City. Every employer shall pay to each of its eligible
9 employees for each hour worked in the city of New York a wage of not
10 less than $13.00 per hour on or after December 31, 2018.
11 (b) Remainder of Downstate. Every employer shall pay to each of its
12 eligible employees a wage for each hour worked in the counties of
13 Nassau, Suffolk and Westchester a wage of not less than $11.00 per hour
14 on or after December 31, 2018.
15 (c) Remainder of state. Every employer shall pay to each of its eligi-
16 ble employees a wage for each hour worked outside of the city of New
17 York and the counties of Nassau, Suffolk, and Westchester, a wage of not
18 less than $10.40 per hour on or after December 31, 2018.
19 8. Notwithstanding the provisions of any other subdivision in this
20 section, every employer shall pay to each employee who is between the
21 ages of fifteen and twenty, for each hour worked a wage of not less
22 than, or if greater, such other wage as may be established by federal
23 law pursuant to 29 U.S.C. section 206 or its successors:
24 (a) New York City. Every employer shall pay to each of its eligible
25 employees for each hour worked in the city of New York a wage of not
26 less than $13.00 per hour on or after December 31, 2018.
27 (b) Remainder of Downstate. Every employer shall pay to each of its
28 eligible employees a wage for each hour worked in the counties of

7 § 2. This act shall take effect December 31, 2018.
