AN ACT to amend the public officers law, in relation to authorizing a
person holding the office of assistant district attorney in the county
of Lewis to reside in an adjoining county within the state
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3 of the public officers law is amended by adding a
2 new subdivision 67 to read as follows:
3 67. In the county of Lewis, the provisions of this section requiring a
4 person to be a resident of the political subdivision or municipal corpo-
5 ration of the state for which he or she shall be chosen or within which
6 his or her official functions are required to be exercised, shall not
7 prevent a person from holding the office of assistant district attorney
8 of the county of Lewis, other than the first assistant district attor-
9 ney, provided that such person resides in Lewis county or in an adjoin-
10 ing county within the state of New York; provided, however, that any
11 person performing such functions or holding the office of assistant
12 district attorney in any other county shall be a resident of such county
13 unless otherwise provided by law. The provisions of this subdivision
14 shall not apply to any person holding the office of first assistant
15 district attorney or chief assistant district attorney, the holder of
16 which would assume the duties of the district attorney upon the district
17 attorney's absence from the county or upon the district attorney's
18 inability to perform his or her duties.
19 § 2. This act shall take effect immediately.
