AN ACT to amend the agriculture and markets law, in relation to requir-
ing the department of agriculture and markets to promote participation
in Nourish New York program for black, indigenous and people of color
site controlled farms
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 452 of the agriculture and markets law is amended
2 by adding a new subdivision 3-a to read as follows:
3 3-a. The commissioner shall provide means, which shall include finan-
4 cial and technical support, including but not limited to infrastructure
5 development, priority grants related to processing and refrigeration
6 systems, permit assistance, creation of a liaison to Nourish New York
7 program, and input to best practices for Nourish New York program, to
8 ensure an effective connection to markets and participation in the Nour-
9 ish New York program by black, indigenous and people of color site
10 controlled farms. The department shall include and prioritize the
11 procurement of agricultural products from black, indigenous and people
12 of color site controlled farms as a core component of the Nourish New
13 York program food distribution system and shall establish a price point
14 for agricultural products from black, indigenous and people of color
15 owned farms that is, at a minimum, sufficient to cover the cost of
16 production, temporary storage and transportation to food relief organ-
17 izations.
18 § 2. This act shall take effect immediately.
