        Introduced  by  Sen.  MAYER  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment Operations
 
        AN ACT authorizing the commissioner of general services to transfer  and
          convey certain unappropriated state land to the town of Bedford
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subject to the provisions of this act  but  notwithstanding
     2  any  other provision of law to the contrary, the commissioner of general
     3  services is hereby authorized, subject to the consent of the commission-
     4  er of corrections and community supervision, to transfer and  convey  to
     5  the  town  of  Bedford  in  the  county  of  Westchester, the state land
     6  described in section two  of  this  act,  owned  by  the  department  of
     7  corrections and community supervision and being a part of lot 60.12-1-1,
     8  in  the  town  of  Bedford  in the county of Westchester, declared to be
     9  abandoned state land by the  department  of  corrections  and  community
    10  supervision.  The  transfer  and  conveyance  of  the  land described in
    11  section two of this act shall be made in consideration of the sum of one
    12  dollar and upon such conditions as the commissioner of general  services
    13  may deem proper.
    14    § 2. The lands authorized by section one of this act to be transferred
    15  and conveyed are as follows:
    16    All  that lot, parcel or piece of land situate in the Town of Bedford,
    17  County of Westchester, State of New York, being a portion of parcel with
    18  Tax ID: 60.12-1-1 and being more particularly described as follows:
    19    Beginning at a point on the westerly line of  Beaver  Dam  Road  Lane,
    20  said  point  being located North 45°52'53" East a distance of 70.41 feet
    21  from the intersection of said Beaver Dam Road and the northerly line  of
    22  Harris  Road;  thence continuing through the lands, now or formerly, The
    23  People of the State of New York (Tax ID: 60.12-1-1) North 46°11'10" West
    24  a distance of 175.18 feet to a point located in the center of  a  brook;
    25  thence  continuing  generally along the centerline of said brook in part
    26  the following fifteen (15) courses:
    27    1. North 33°31'14" East a distance of 110.41 feet;

    18    2. Along a curve to the right having a radius of  733.50  and  an  arc
    19  length of 327.17 feet;
    20    3. South 55°15'47" West a distance of 98.10 feet;
    21    4. South 55°07'43" West a distance of 397.39 feet;
    22    5. South 50°36'45" West a distance of 99.42 feet and
    23    6. South 45°52'53" West a distance of 76.64 feet
    24    To the point or place of Beginning containing 9.134 Acres.
    25    Subject  to  any  enforceable  easements, restrictions or covenants of
    26  record that may exist.
    27    § 3. The description in section two of this act is not intended to  be
    28  a  legal  description,  but  is  intended  to  identify the parcel to be
    29  conveyed. As a condition of the transfer, the town of Bedford may submit
    30  to the commissioner of general services, for his  or  her  approval,  an
    31  accurate  survey  and description of the lands to be conveyed, which may
    32  be used in the conveyance thereof.
    33    § 4. The office of general services shall not transfer or  convey  the
    34  aforesaid  land  unless the application is made to the office of general
    35  services by the town of Bedford within one year after the effective date
    36  of this act. Said application shall be  in  the  form  of  a  resolution
    37  setting  forth  a  comprehensive  statement approved by the Bedford town
    38  board acknowledging and accepting the  use  restrictions  set  forth  in
    39  section five of this act.
    40    §  5.  The  transfer and conveyance made pursuant to this act shall be
    41  subject to the following use restrictions and reverter:
    42    (a) The land described in this act shall be used exclusively  for  the
    43  purposes  of  operating and maintaining a wastewater treatment plant and
    44  appurtenant facilities and operations as reasonably may be necessary  or
    45  desirable in connection therewith and water quality control.
    46    (b)  The  conveyance of the land described in this act shall contain a
    47  covenant and restriction requiring that the land be used for the purpose
    48  set forth in subdivision (a) of this section. In the event the  premises
    49  are  not  accepted  and/or used for such purposes, ownership of the land
    50  shall revert to the state of New York.
    51    § 6. This act shall take effect immediately.
