        Introduced by Sen. FERNANDEZ -- read twice and ordered printed, and when
          printed to be committed to the Committee on Disabilities
 
        AN  ACT  to  amend  the  executive law, in relation to the protection of
          vulnerable persons who receive recovery support services
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 2 of section 551 of the executive law, as added
     2  by section 3 of part A of chapter 501 of the laws of 2012, is amended to
     3  read as follows:
     4    2.  The  executive director shall recommend policies and procedures to
     5  the state oversight agency for the  protection  of  vulnerable  persons,
     6  including  but  not  limited  to  policies  and  procedures: (a) for the
     7  protection of vulnerable persons who reside in or receive services  from
     8  facilities  or  provider  agencies  as  set forth in subdivision four of
     9  section four hundred eighty-eight of the social services law, or  recov-
    10  ery  support services; (b) relating to assuring, on behalf of the state,
    11  that vulnerable persons are afforded care that is of  a  uniformly  high
    12  standard; (c) relating to assuring, on behalf of the state, that vulner-
    13  able  persons are afforded the opportunity to exercise all of the rights
    14  and responsibilities accorded to residents of  the  state;  and  (d)  to
    15  harmonize  and  improve the procedures for and quality of investigations
    16  of reportable incidents involving vulnerable persons within the  differ-
    17  ent systems of care in the state.
    18    § 2. This act shall take effect immediately.
