AN ACT to amend the New York state urban development corporation act, in
relation to establishing a New York business COVID-19 modification
grant program; and providing for the repeal of such provisions upon
the expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1 of chapter 174 of the laws of 1968, constituting
2 the New York state urban development corporation act, is amended by
3 adding a new section 16-bb to read as follows:
4 § 16-bb. New York business COVID-19 modification grant program. 1.
5 Notwithstanding any inconsistent provision of law to the contrary, with-
6 in amounts allocated to the state of New York by the federal Coronavirus
7 Aid, Relief, and Economic Security (CARES) Act of 2020 (P.L. 116-136)
8 that have not otherwise been obligated, the empire state development
9 corporation shall make grants available pursuant to this section to
10 provide grants for New York state business enterprises, as defined in
11 section one hundred thirty-nine-i of the state finance law, or non-pro-
12 fitmaking organizations as defined in section one hundred ninety of the
13 labor law, to cover expenses related to complying with any state-mandat-
14 ed guidelines for reopening, pursuant to any executive order related to
15 the state disaster emergency declared pursuant to executive order 202 of
16 2020, including, but not limited to, modifying the layout of a building,
17 technology upgrades, the purchase of new equipment and supplies, includ-
18 ing personal protective equipment, and training employees on new busi-
19 ness practices necessary to comply with any such order. Such grants
20 shall also be allowed for the reimbursement of such expenses which were
21 incurred to comply with any state-mandated guidelines for reopening that
22 were expended prior to the application or award of such grant.
23 2. (a) Grants made pursuant to this section shall, as far as practica-
24 ble, be equitably distributed among all regions of the state, reflective
25 of the economic impact on each region due to the closure or limitation
26 of business operations due to any executive order issued by the governor

1 related to the state disaster emergency declared pursuant to executive
2 order 202 of 2020.
3 (b) Priority for grants pursuant to this section shall be given to
4 small businesses as defined in section one hundred thirty-one of the
5 economic development law.
6 3. The empire state development corporation shall create an applica-
7 tion process for such grants, and shall promulgate rules and regulations
8 for awarding and distributing grants pursuant to this section.
9 § 2. This act shall take effect immediately and shall expire and be
10 deemed repealed October 1, 2021.
