        Introduced  by  Sens. AMEDORE, HANNON -- read twice and ordered printed,
          and when printed to be committed to the Committee  on  Alcoholism  and

        AN ACT to amend the mental hygiene law, in relation to  establishing  an
          opioid treatment services demonstration program
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision (d) of section 32.31 of the mental hygiene  law
     2  is amended by adding a new paragraph 7 to read as follows:
     3    7.  Notwithstanding  the  provisions  of this subdivision or any other
     4  rule or regulation to the contrary, the commissioner shall  implement  a
     5  demonstration  program  to  increase  consumer  accessibility  to opioid
     6  treatment services in geographic areas determined by the commissioner to
     7  be in need of such services. In implementing such demonstration program,
     8  the commissioner may approve an application by  a  facility  seeking  to
     9  provide  opioid  treatment  services  that would be operated by a corpo-
    10  ration, the stock of which is owned by another corporation, or  a  part-
    11  nership  or  limited liability company with members that are not natural
    12  persons, provided that the applicant, the applicant's  principal  stock-
    13  holders,  and  members,  as  applicable, and the applicant's controlling
    14  persons, comply with all other applicable requirements of  this  article
    15  and the regulations of the commissioner.
    16    §  2.  The  office  of  alcoholism  and substance abuse services shall
    17  assess the efficacy of the demonstration program established pursuant to
    18  paragraph 7 of subdivision (d) of section 32.31 of  the  mental  hygiene
    19  law,  as  added  by  section  one of this act, and issue a report to the
    20  governor, the temporary president of the senate and the speaker  of  the
    21  assembly,  identifying  the  number  of  facilities  approved to provide
    22  opioid  treatment  services  in  accordance  with  such  paragraph,  the
    23  geographic  distribution  of  such  providers,  and  the level of access
    24  provided to low income populations, on or before December 31, 2022.

     1    § 3. This act shall take effect immediately, provided,  however,  that
     2  the  office  of  alcoholism  and  substance  abuse services shall not be
     3  permitted to issue any application approvals pursuant to paragraph 7  of
     4  subdivision  (d) of section 32.31 of the mental hygiene law, as added by
     5  section one of this act, after December 31, 2022.
