        Introduced  by  Sen.  PARKER -- read twice and ordered printed, and when
          printed to be committed to the Committee on Investigations and Govern-
          ment  Operations  --  committee  discharged,  bill  amended,   ordered
          reprinted as amended and recommitted to said committee
 
        AN  ACT  to amend the cannabis law, in relation to employment at certain
          licensees for the purposes of parole conditions

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 6 of section 127 of the cannabis law is amended
     2  to read as follows:
     3    6.  (a)  A  person  currently  under  parole, probation or other state
     4  supervision, or released on recognizance,  non-monetary  conditions,  or
     5  bail prior to being convicted, shall not be punished or otherwise penal-
     6  ized  for conduct allowed under this chapter unless the terms and condi-
     7  tions of said parole, probation, or state supervision explicitly prohib-
     8  it a person's cannabis use or any other conduct otherwise allowed  under
     9  this  chapter.  A person's use of cannabis or conduct under this chapter
    10  shall not be prohibited unless it has been shown by clear and convincing
    11  evidence that the prohibition is reasonably related  to  the  underlying
    12  crime.  Nothing  in this provision shall restrict the rights of a certi-
    13  fied medical patient.
    14    (b) A person currently, or prospectively, under parole,  probation  or
    15  other state supervision, who as a condition of such parole, probation or
    16  other  state  supervision  is  required to be employed, may fulfill such
    17  employment requirement through employment at  any  licensee  under  this
    18  chapter  unless  the  terms and conditions of said parole, probation, or
    19  state supervision explicitly prohibit such person's employment  at  such
    20  licensee.
    21    § 2. This act shall take effect immediately.
