        Introduced  by Sen. STAVISKY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the education  law,  in  relation  to  the  issuance  of
          certificate  of  residence  forms to individuals desiring to enroll in
          community colleges as non-resident students
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  2  of  section 6222 of the education law, as
     2  added by chapter 305 of the laws of 1979, is amended to read as follows:
     3    2. (a) The methods and procedures for the admission of such  non-resi-
     4  dent  students  to  the  city  university of New York community colleges
     5  shall be in  accordance  with  the  provisions  of  section  sixty-three
     6  hundred  five of this [chapter] title.  Notwithstanding any inconsistent
     7  provision of law, any reference contained in  such  section  sixty-three
     8  hundred  five  to  the state university trustees or to the chancellor of
     9  the state university of  New  York  shall,  for  the  purposes  of  this
    10  section,  be  deemed  to mean and refer to the board of trustees and the
    11  chancellor of the city university of New York, respectively.
    12    (b) Provided, further, in accordance with section six  thousand  three
    13  hundred  five of this title, the chief fiscal officer of each county, as
    14  defined in section 2.00 of the local finance law, shall,  upon  applica-
    15  tion and submission to him of satisfactory evidence, issue to any person
    16  desiring  to  enroll in a community college as a non-resident student, a
    17  certificate of residence form showing that said person is a resident  of
    18  said  county.  If  the chief fiscal officer of a county refuses to issue
    19  such a certificate on the ground that the person  applying  therefor  is
    20  not  a  resident  of  such county, the person applying may appeal to the
    21  chancellor of the city university. The chancellor of the city university
    22  shall make a determination after a hearing, upon  ten  days'  notice  to
    23  such chief fiscal officer of the county, and such determination shall be
    24  final  and  binding on the county. Such person shall, upon his registra-
    25  tion for each college year, file with the college such a certificate  of
    26  residence  form  issued  not  earlier than two months prior thereto, and
    27  such certificate of residence form shall be valid for a  period  of  one
    28  year from the date of issuance.
    29    § 2. This act shall take effect immediately.
