        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on  Agriculture  --  reported

          retaining its place in the order of second report

        AN  ACT  to amend the agriculture and markets law, in relation to alter-
          nate generated power source at retail gasoline outlets
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subparagraph  (ii)  of paragraph (f) and paragraph (k) of
     2  subdivision 1 of section 192-h of the agriculture and  markets  law,  as
     3  added  by  section  2  of  part S of chapter 58 of the laws of 2013, are
     4  amended to read as follows:
     5    (ii) Lower Mid-Hudson region: Includes Putnam, Rockland and  Westches-
     6  ter counties.
     7    (k)  "Retailer"  means  any  person  who owns, operates, or controls a
     8  retail outlet that is subject to the requirements of subdivision two  of
     9  this section, provided however, that any retail outlet located in Putnam
    10  county  shall  only  be  subject  to  the  requirements  of this section
    11  provided that funding  and  program  services  are  available  for  such
    12  purposes  under  subdivisions  twenty and twenty-one of section eighteen
    13  hundred fifty-four of the public authorities law.
    14    § 2. This act shall take effect immediately.
