        Introduced  by  Sen.  MAY  --  read  twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT requiring the commissioner of  health  to  promulgate  rules  and
          regulations requiring nursing homes and residential health care facil-
          ities  to  test  all  residents  of such nursing homes and residential
          health care facilities for the novel coronavirus (COVID-19)

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  (a)  Within 14 days after the effective date of this act,
     2  the commissioner  of  health  shall  promulgate  rules  and  regulations
     3  requiring  nursing  homes and residential health care facilities to test
     4  all residents of such nursing homes and residential health care  facili-
     5  ties  for  the  novel  coronavirus  (COVID-19) during the state disaster
     6  emergency declared pursuant to Executive Order Number 202  of  2020,  as
     7  amended, every 30 days, and additionally, within one week after a member
     8  of  the  staff of the facility or nursing home or another resident tests
     9  positive for COVID-19, and for sixty days after the expiration  of  such
    10  Executive Order, as amended.
    11    (b) Sixty days after the state disaster emergency declared pursuant to
    12  Executive Order Number 202 of 2020, as amended, has ended, all residents
    13  of  nursing homes and residential health care facilities shall be tested
    14  for the novel coronavirus (COVID-19) within 7 days after a member of the
    15  staff or another resident of such nursing  home  or  residential  health
    16  care  facility  tests  positive for the novel coronavirus (COVID-19) and
    17  shall subsequently be tested 30 days thereafter.
    18    § 2. This act shall take effect immediately.
