AN ACT to amend the public health law, in relation to hospital compli-
ance with federal hospital price transparency law and rules
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2805 of the public health law is amended by adding
2 a new subdivision 3 to read as follows:
3 3. (a) The commissioner shall report monthly on hospital compliance
4 with federal hospital price transparency law, rules and regulations.
5 Such report shall be conspicuously posted on the department's website.
6 (b) Effective April first, two thousand twenty-five, no hospital
7 shall access any funds pursuant to section twenty-eight hundred seven-k
8 of this article if they are not in material compliance with federal
9 hospital price transparency law, rules and regulations. The commission-
10 er may allow continued access to the fund if such commissioner deems the
11 facility essential and is making progress towards compliance with feder-
12 al hospital price transparency law, rules and regulations. Such determi-
13 nation shall be made on a yearly basis.
14 § 2. This act shall take effect on the one hundred eightieth day after
15 it shall have become a law. Effective immediately, the addition, amend-
16 ment and/or repeal of any rule or regulation necessary for the implemen-
17 tation of this act on its effective date are authorized to be made and
18 completed on or before such effective date.
