        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be  committed  to  the  Committee  on  Rules  --  committee
          discharged, bill amended, ordered reprinted as amended and recommitted

        AN  ACT  to  amend  the  environmental  conservation law, in relation to
          providing that one hundred percent of in-state sales of new  passenger
          cars and trucks shall be zero-emissions by two thousand thirty-five
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The environmental conservation law is amended by  adding  a
     2  new section 19-0306-b to read as follows:
     3  § 19-0306-b. Zero-emissions cars and trucks.
     4    1.  It  shall  be  a  goal  of  the  state that one hundred percent of
     5  in-state sales of new passenger cars and trucks shall be  zero-emissions
     6  by  two  thousand thirty-five.   It shall be a further goal of the state
     7  that one hundred percent of medium-duty and heavy-duty vehicles  in  the
     8  state  be  zero-emissions  by two thousand forty-five for all operations
     9  where feasible. It shall be further a goal of the state to transition to
    10  one hundred percent zero-emissions off-road vehicles  and  equipment  by
    11  two thousand thirty-five where feasible.
    12    2.  The  department,  to the extent consistent with federal law, shall
    13  develop and propose:
    14    a.  Passenger  vehicle  and  truck  regulations  requiring  increasing
    15  volumes  of  new  zero-emissions  vehicles sold in the state towards the
    16  target of one hundred percent of in-state sales by two thousand  thirty-
    17  five.
    18    b. Medium-duty and heavy-duty vehicle regulations requiring increasing
    19  volumes  of new zero-emissions trucks and buses sold and operated in the
    20  state towards the target of one hundred percent of the fleet transition-
    21  ing to zero-emissions vehicles by  two  thousand  forty-five  everywhere
    22  feasible.
    23    c.  Strategies,  in  coordination  with  other  state agencies and the
    24  federal environmental protection agency, to achieve one hundred  percent
    25  zero-emissions  from  off-road  vehicles and equipment operations in the

     1  state by two thousand thirty-five.   In implementing the  provisions  of
     2  this paragraph, the department shall act consistently with safety, tech-
     3  nological feasibility and cost-effectiveness.
     4    3.  The  department,  in  consultation with the department of economic
     5  development, the New York state energy research and development authori-
     6  ty, the public service commission, the department of transportation, the
     7  department of motor vehicles, and other state agencies,  local  agencies
     8  and  other  interested  parties,  shall develop a zero-emissions vehicle
     9  market development strategy by January thirty-first, two thousand  twen-
    10  ty-two, and an update every three years thereafter, that:
    11    a. Ensures coordinated and expeditious implementation of the system of
    12  policies,  programs  and  regulations necessary to achieve the goals and
    13  orders established by this section.
    14    b. Outlines state agencies' actions to  support  new  and  used  zero-
    15  emissions  vehicle  markets for broad accessibility for all residents of
    16  this state.
    17    4. The department, the New York state energy research and  development
    18  authority, the public service commission and other state agencies, shall
    19  use existing authorities to accelerate deployment of affordable powering
    20  options  for zero-emissions vehicles, in ways that serve all communities
    21  and particularly low-income and  disadvantaged  communities,  consistent
    22  with state and federal law.
    23    5.  The department, the New York state energy research and development
    24  authority, the department of motor vehicles and the department of trans-
    25  portation, in consultation with the other state agencies,  shall  on  or
    26  before  July  fifteenth,  two  thousand  twenty-two,  identify near term
    27  actions and investment strategies to improve sustainable transportation,
    28  freight and transit options, including where feasible:
    29    a. Supporting bicycle and pedestrian options, particularly in  low-in-
    30  come  and  disadvantaged communities in the state, by incorporating safe
    31  and accessible infrastructure into projects where appropriate.
    32    b. Supporting light, medium, and  heavy-duty  zero-emissions  vehicles
    33  and  infrastructure  as  part  of  larger transportation projects, where
    34  appropriate.
    35    § 2. This act shall take effect immediately.
