  TITLE OF BILL: An act prohibiting the approval of a charter school application when such school would operate within the Buffalo city school district; and providing for the repeal of such provisions upon expiration thereof   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to establish a temporary moratorium on the establishment of new charter schools in the city of Buffalo.   SUMMARY OF PROVISIONS: Section one provides that no application to establish a charter school shall be approved by any charter entity if such proposed charter school would operate within the Buffalo city school district. Section one further provides that a charter that has been surrendered, revoked or terminated within the Buffalo city school district on or after July 1, 2021, including a charter that has not been renewed by action of its charter entity, shall not be reissued within the Buffalo city school district. Section two provides for an immediate effective date and repeals the act on June 30, 2024.   JUSTIFICATION: The Buffalo city school district is currently at an over saturation point with charter schools. It is appropriate to establish a temporary moratorium on the establishment of new charter schools in Buffalo to provide time for the school district and other stakeholders to assess the landscape of the educational systems and ensure all students in Buffalo are receiving an excellent education.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: To be determined.   EFFECTIVE DATE: This act shall take effect immediately and shall expire and be deemed repealed June 30, 2024.

        AN ACT prohibiting the approval of a  charter  school  application  when
          such school would operate within the Buffalo city school district; and
          providing for the repeal of such provisions upon expiration thereof

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any provision of law, rule or regulation to
     2  the contrary, commencing on July 1, 2021, no application to establish  a
     3  charter  school  submitted pursuant to section 2851 of the education law
     4  shall be approved by any charter entity if such proposed charter  school
     5  would  operate  within  the Buffalo city school district. Furthermore, a
     6  charter that has been surrendered,  revoked  or  terminated  within  the
     7  Buffalo city school district on or after July 1, 2021, including a char-
     8  ter that has not been renewed by action of its charter entity, shall not
     9  be reissued within the Buffalo city school district.
    10    §  2.  This  act shall take effect immediately and shall expire and be
    11  deemed repealed June 30, 2024.
