TITLE OF BILL:
An act to amend the social services law, in relation to the standards of
payment for care provided foster children
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill would amend the social services law to require a three percent
increase in the total reimbursement provided for the care of foster
children beginning January first of the year succeeding. the date of
enactment.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 of this bill amends Section 398-a by adding a new subdivision
6 requiring a three percent increase in the total reimbursement provided
for the care of foster children beginning the first of January, after
the bill is enacted into law. 2 states that this act shall take effect
immediately.
 
JUSTIFICATION:
The most recently reported data indicates that the annual cost of foster
care ($25,000) is dramatically lower than the cost of residential
services ($92,000). While this lower cost has saved taxpayers appreci-
able money, it has also left the very families that are the backbone of
New York State's foster care system struggling to survive due to the
rising cost of basic necessities.
This legislation recognizes the financial stress faced by foster care
families as they seek to provide love, nurturing and the basic necessi-
ties of life to thousands of children throughout New York by providing a
three percent increase in support for those families. By doing so this
legislation also strengthens the current state supervised and locally
administered foster care system.

AN ACT to amend the social services law, in relation to the standards of
payment for care provided foster children
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 398-a of the social services law is amended by
2 adding a new subdivision 7 to read as follows:
3 (7) Notwithstanding any provisions of this section to the contrary,
4 beginning the first of January next succeeding the effective date of
5 this subdivision, the total reimbursement dictated pursuant to the stan-
6 dards of payment for care provided to foster children shall be increased
7 by three percent.
8 § 2. This act shall take effect immediately.
